I have been waiting 19 months for approval for a total knee replacement.

3 months after my injury 11/05 I had meniscus surgery on the right knee, one year later I had surgery on the left knee, and this was also meniscus surgery, an overuse injury.

Currently I am being treated for my low back in physical therapy and have nerve involvement in the right leg/foot.

The spine institute relates the back problems to my right knee.

The last few months I have noticed my right knee getting weaker and today it gave out, (collapsed) and I fell on a concrete floor and went down hard.

I am writing this after midnight because I hurt too much to sleep.

My questions is should I report this to my attorney, ( at this time I am not being treated for my right knee) or is this something the wc Ins Co will use against me to get out of paying for my needed knee replacement?

BK - YES, YES, YES, I would not even wait until Monday but call him now if you're still up and leave a message!!! Let him know you fell and that you will contact him Monday.

If this is an accepted claim I would think an ER visit would be covered by WC, but even if not you should still go if you are in a lot of pain. Please be careful and call your attorney...he needs to know this happened!!!

BK.....I agree totally with Monster. I sprained a meniscus in '04. Pain has never come back but I am left with a buckling knee. IT caused my lower body injuries to my back and ankle this time around. It's verydangerous, causes other problems. You get to the point that you are afraid to walk and do it very carefully because you never know WHEN it will buckle on you. Took my ankle one year for the welling to go down because I rolled over on it when my knee buckled. All related. Make sure your attorney is aware. WC gives us a hard time with everything. As long as your attorney knows it's documented and he can guide you in the right direction. Ice it, stay off it for a few days and please be careful walking and especially going up an down steps. I have also noticed I have to have sneakers on. Tried a pretty pair of sandals and while walking up the steps, the buckling caused me to go down. Prayers are coming your way.

I'm on board with the above! This fall occurred due to your injury and it's side effects, and needs to be added to your file A.S.A.P! Call or E-mail your Attorney and leave all the particulars of how this happened while it's still fresh in your Mind!! If your Attorney feels it should not be used they will tell you, but get all the info. to them as quickly as you can!!Wink

Failed Back Surgery, Chronic Pain, Totally Disabled.

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!

I agree with the rest of the group. For instance, any time you have an area of the bone that is weakened the other bones compensate for the weakness. If they do this for any length of time, the bones begin to realign themselves to manage the compensation. Just think what this does to the muscles which are attached to the bones. This is a good example of the IC being foolish and allowing the IW to get worst by denying the care up front and then the IW has to be concerned if the IC will pay for the results of their decision. I am so tired of hearing about good people not receiving the care they deserve. Bummer do you know how much longer before they will accept responsibility for your knee and allow you to have the surgery. There are so many diseases that their is nothing a doctor can do about progression so when because of an IC prgression is seen such as in your back now falling my heart just breaks. Why the government allows the IC to run our healthcare is beyond me. All insurances need to have greater regulatories that monitor their activity. Oh well..now I am on my soap box..

Red...and rightfully so. Stay on that soap box. It is a disgrace what people are put through. Made to get worse while all of these unnecessary delays are going on. Waiting over a year for surgery made the muscles in my arm die. The coming back to life after all this time is horrible. Since using only my right hand ( to lean on to get out of the tub, to turn over in bed) has made my right wrist give out now whenever I put any pressure on it. The IME I saw stated that none of my other health issues have beenaffected by my comp injuries. The Judge disagreed. My diabetes has gone whacky at times because of all the steroid injections and pain. My BP has sky rocketed due to pain , fear, worry. And i have read numerous times that a female diabetic over age 50 is a bad candidate for the surgery I had and most likely not to heal fully AND to aquire frozen shoulder. Something needs to be done to regulate thier stall tactics. You know, an employee works hard, gets hurt and then suffers to no end. Aquires other health issues on top of it all that maybe they would have never had. It's beyond being inhumane.

Thanks everyone,

I did get about 3 hours of sleep. I still am hurting, what concerns me is I can no longer go from a sit to stand position without my knee locking-up, this makes it very difficult to straighten my leg and it is very painful when this happens.

When I fell it was a direct hit on my bad knee. The pain in my back also made it difficult to sleep last night

Today my family is having a family reunion and I am in charge.
I estimate 73-80 people attending from 10 states.

If I am still hurting like this later today I will go to ER.

I have a court date scheduled for Aug 28, I believe it is on my knee.

My heart just crys over all this. I have a disease that inspite of all the latest treatment does progress. That is very sad, but it is even worse when it is happening and it does not have to happen. I so wish I were stronger I believe that I would want to find a way to form a lobby group to go to DC and make some statements. Find a way to testify in front of the senate commission. I know the mother of megan, the child that created what is called megan's law. I wish I was strong enough to make this happen. This is just an outcry of injustice. I am having a hard time putting my thougts down right now because I can't see well and I can't move my hands well and their appears to be a blockage to process information in my head, but I expect this. I expect to be living in a nursing home someday because of progression, I do not expect that someone who has been hurt and can be fixed to continual to decline to the point of falling down. Bummer I am so sorry. My heart is crying for you and then you have this family thing today while you are thinking about going to the ER. Way to much for my body and brain. My prayers are with you today. You are just a courageous women. God be with you and bless you. Carol

BK....please be careful. I feel so bad that you are getting more and more pain in other areas. You may have also twisted your back when you fell. Am wishing a wonderful day for you, hopefully pain free to enjoy your family. Please take yourself to the ER if you are still hurting.
