Question regarding employee termination while on compensation
I'm in Pennsylvania and have a question regarding an employee being terminated while out on workman's compensation. If you are out on workman's compensation and the employer terminates you but tells you that your workman's compensation will continue does that mean that you are going to lose the money that is coming in and that now they are only responsible for paying the medical bills even though your injury prevents you from getting gainful employment to support your family or collecting unemployment because to collect unemployment you have to be willing and able to find work?

No, a termination will not affect your workers' comp case. Wage and medical benefits should continue for as long as you are not able to work, or statutory limits are met.

Thank you, I was under the assumption that when termination was instituted that they were only responsible for your medical benefits and not your salary since you aren't salaried by them anymore since you were terminated. |

The IC follows the injury , the employer can end and you are still covered.

while you are disabled you don't get salary(paid by employer)
disability payments (paid by carrier) are based on your work limitations. there could be problem if you are released to light/modified work. |

Hi Lawman, and Welcome to the Forum!! Cap. and I are both from Pa. also, and if You are Terminated Your Monetary and Medical Continues for as long as Your Injury is Stopping You from Work. If in the Future You are Released with Restrictions to Return to Work, that May be a Different Situation. Have a Great Day!!

It was a coincidence that I was terminated while I was on comp. The needed an out to get rid of me and they found it. |

With Our State being an "At Will" Employment State, unless You have a Contract or a Union to File a Grievance to, We can be Fired for Holding Our Hands the Wrong Way!!
