I agree......God does provide. My husband and i both went through the WC system. Him first and 3 years later me. He wasn't settled yet when I was injured. Everytime we spent our last $1 , evertime I really thought this was it we have to sell the house, the good Lord provided. We made it , not easily and with the prayers of alot of good people, our faith , and God watching over us.

God is never late.

In the end it doesn't matter how many years were in your life but how much life was in your years.

Stay Strong, and Keep Up the Fight!! Appeal that UE Denial, and Ask for a Hearing, it seems to Me that if You were let go, or Left for a Good reason, the Very Least You should be Eligible for is UE! I think I got some good news today. My lawyer left a message on my machine saying that my next court date is in Feb. The insurance company is working on a settlement package. could this actually be coming to an end? I am going to call him back tommorow. Do you guys think that this means my employer has accepted responsibility and I should be able to return to the doctor to continue treatment? That is what I need.I have been waking up with more tightness than usual and wheezing lately. It's been subsiding after awhile but it's still getting worse.

Be careful of any settlement, read the details, go over the details. Make sure your future medical is open.

But one question is still lingering, they've never paid you WC benefits, they claim that your injury was not work related. Now they want to settle.

Ask your lawyer if this settlement is in your best interest. Ask for an IME, find out if you qualify for a total body settlement, it makes a big difference on your settlement.
I read about alot of people settling to just try and get out of a bind and are later on left without medical care. If your pulmonary problems are truly related to your work you'll have problems getting any employer's ins to cover your meds, etc.

Generally in a situation like this the IC pays all back pay. Then within months settlement talks start going quickly. This is how my husband's played out. He received 3 years of backpay and then settled 8 months later with open medical for life.

My case was easier. I got my backpay 14 months after injury and settled a year later with no medical. My employer was self insured and my attorney advised me that it was the best I would do. Knowing what I know of other cases within other co-workers....it was a good move on my part. They never denied me medical attention and my employer and me knew my time there was up. I would have been crippled had I ever returned.

I talked to my lawyer and he said that settlement is the way to go only if I agree with it. When we are presented with it then he and I will sit down and go thru it and see.I asked him about back pay till we settle and he said the way I would get that is if we goto trial and win then I will get backpay and continued pay and a settlement later is if we win and they appealed the decision.As you said bodybuilder for me to accept settlement, there has to be some form of medical in it.

I really don't see how you could loose through court. You have no medical history of pulmonary problems before this job.

I dont think their is anyway I could lose in court either.I have had the same physician for the last 9 years and always had clean bill of health and physicals. Now cant walk up a flight of stairs without my chest tightening up and wheezing a bit. But its better than when I was working there and I couldnt function without steroids.I have to live with asthma, COPd the rest of my life but at least I'll live.Has anyone been offered any kinda settlement for permanent pulmonary damage? It seems everyone here is back and muscle, and surgical issues. If anyone else comes across a pulmonary post could you please let me know.Thanks BB, lilly, cap,1171,limbo and all you guys that have put so much info and support in this post and board.It's helped me off the ledge of the building.now I'm just lookin over at it.

Quick update .I applied for SSDI, as you guys suggested. Then some people here said I wouldnt be elgible cause I havent been out of work long enough. I just received a phone call from the local office here needing more info to proceed with my case. She told me that I was eligible, not approved, but eligible for SSDI after being out of work for 5 months. I dont know if it is different in Michigan than other states but the timeline isnt a year its 5 months.
