Wife works for University Hospital in Michigan and was encouraged my University generated E-Mails to get their free flue shot at certain sites around the complex. Few days afetr getting shot she came down with Guillain-Berre. She has been hospitalized since 10/1/09 and is expected to be released 11/24/09 this followed by 3 to 4 months of out-patient O.T. & P.T. therapy. She has been told this is not workmens comp besause it was her choice to get the flue shot. This was not the h1n1 shot.

Risk Factors
A risk factor is something that increases your chance of getting a disease or condition. Risk factors for Guillain-Barré syndrome may include:

Recent bacterial or viral infection (Most common are respiratory or gastrointestinal infections.)
Recent vaccine
The swine flu vaccine administered from 1976-1977 was associated with excess cases of Guillain-Barré syndrome. (Since then, no other influenza virus vaccines have been associated with Guillain-Barré syndrome.)

I'm sorry about your wife's illness. Contact several Workers Compensation Lawyers and don't let up until you find one who'll tackle this for you.

I think it is the Meningitis vaccine that they push for kids and teens that also carries a high risk of GB..... I need to look this disease up. I never heard of it before I saw the commercials for the meninghitis vaccine. Scary.

VIII. Compensation Fund

In addition to conferring immunity to manufacturers, distributors,
and administrators of the Covered Countermeasures, the Act provides
benefits to certain individuals who sustain a covered injury as the
direct result of the administration of the Covered Countermeasure. The
Countermeasure Injury Compensation Program (CICP) within the Health
Resources and Services Administration (HRSA) administers the Act's
compensation program. Information about the CICP is available at 1-888-

Section VIII, strike the first sentence and insert: ``The
Declaration for the Use of the Public Readiness and Emergency
Preparedness Act for H5N1 was published on January 26, 2007; amended on
November 30, 2007 to add

H7 and H9 vaccines; amended on October 17, 2008 to add H2 and H6
vaccines; amended on June 15, 2009 to add 2009 H1N1 vaccines and
republished in its entirety.''

How to File and Deadline for Filing

Individuals have one (1) year from the date the vaccine or other covered countermeasure was administered to request compensation benefits.


Individuals who would like to file a CICP Request for Benefits may send a letter documenting their intent to file to:

The letter of intent to file should include:

the name, current address, and phone number of the requestor of benefits;
the covered countermeasure received, the date it was received, the circumstances under which the covered countermeasure was received (e.g., clinical trial sponsored by the National Institutes of Health), and the name of the countermeasure recipient if the requestor is filing a death claim.
Although it is not required, requestors may engage the services of an attorney or other representative to render services in connection with the request for benefits. However, the payment of fees and/or costs by CICP of an attorney or other representative is not permitted.
