Permanent disability now what?
I live in California. The AME's report said I am permanantly disabled. Now the wkmn's comp insurance co has stopped paying me the temp disability benefits and are paying me $400 less a month for permanent disability benefits. My doctor hasn't released me yet, although he might soon since I'm not getting any better. Fortunately, I have some state disability left, but not much longer!
What's next? I also can't go back to my old career, what will they do about that if any? Some insight would be appreciated very much. Thank you |

Hopefully the AME gave a whole person impairment rating of the extent of your disability. this rating is given to the state to calculate how long your permanent disability payments will continue.
the higher the rating the longer the payments will last. medical treatment will continue for however long the doctors say. you will likely be given an opportunity to cashout your permanent disability and future medical benefits for a lumpsum (compromise & Release) or you can continue the periodic payments with open medical. if you have reached maximum recovery I'm not sure if SDI will be available to you. I don't know the percentage of permanent disability but as for my employer, they terminated me about 6 months after I was out. I've gotten as well as I can unless I do surgery which I don't want to do. I get pain relief through exercise and occasional medication, I want to give my body a chance to heal itself. It took many years to get injured, it doesn't go away quickly.
I was wondering when will the workman's comp insurance company going to make me an offer? |

your atty can make a demand at any time but nothing can be approved until you have a rating.

Being patient is one thing, not having enough months left on State disability benefits is another. I won't be able to live on what the perm disability the workman's comp insurance co is paying me

yes it's only a partial help. total disability is reserved for those with little or no chance to ever be able to work again.
you will need a replacement job. stay positive. |
