What is the big secert anyway's. from where I sit, i don't really know the person other then by Screen Name here. They can say their from one State and live in another. But, who cares, other then what we do all the time here sharing information.

As I Mentioned in My Original Post on this Thread, I have already Turned Down a Low 6 Figure Amount, with a Fully Funded MSA. Some May think Me Crazy, but My Case has Circumstances that in the End is going to Change and Expand a Law in the Commonwealth Courts of Pa., and Help Many Injured Workers to Come in My State. I'm not doing it for Future Injured Workers, I'm doing it for Myself and My Family, it's just an Added Bonus Others will be Helped by My Battle. I'm not Asking for Much More in the Scheme of Things than what I was Offered, but My Attorney and I know that by Fighting a bit Harder, and not just Settling so I don't have to Deal with My Life under a Microscope, I will get what I Deserve, My Attorney will get Recognition, and Others will be Helped! I am going to Fight, as I Said from Day One, I don't want a Penny More than I'm Due, and not a Dime Less! The w/c System here in Pa. is Tough, and so is My Attorney, and it's Really not the System that Pushes Me so Hard to Beat Them! It's My Employer, and the Tricks and Games They Played during My Battle, and when I get My Big Pay Day, Hopefully Their w/c Premiums will Soar!! I went to Work for Security for Myself and My Family, My Employer sent Me on a Job I Argued Strongly against, because it was way too Dangerous, I had been to it Once before and almost Rolled a Truck, and I had to Catch a 450lb. 7' Tall Piece of Computer Equip. or an 18 Year Old Boy would have Lost Both of His Legs!! Money will Ease My Stress Level and Provide Security for My Family, but I'll Still Awake Daily in My Hospital Bed in Severe Pain, so I will Never Win!! But My Family will be Financially Secure!!Wink

Failed Back Surgery, Chronic Pain, Totally Disabled.

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!

in my mind that is one of the big negatives about the whole idea of insurance. it seems to encourage risky behavior.
the bottom line comes down to insulation from accountability and reponsibility. It's one thing for companies and organizations to try and mitigate the unexpected and uncontrolled actions of outside forces.
Unfortunately what often happens is that behavior that is dangerous to others is allowed to continue when the consequence will fall elsewhere.
when the link between consequences and behavior is broken there is room for abuse.
what started out as help and protection from the unforeseen soon becomes "risk it all
for the chance at big profits since I can't get hurt others have to look out for themselves"....

IMO i wasn't doing anything risky when thoses boxes fell on me.I'm sure i'm not the only one.I would lik enothing more than to go back to supporting my family and that won't happen ever yet i still fight with I/C about everything.I have video of my accident and mri's and emg to say i was damaged at work

I was a very Well Paid Commissioned Class A Driver, and I was Sent on this Particular Job because it was Dangerous, and My Crew was One of the Best There! The Truck I Drove when Injured was a Class B Truck, and I was Told by Dispatch that if I didn't do this "Favor" for Him, because His A** was on the Line for taking the Job, My Tractor wouldn't be Pulling Many Loads, and if it did Pull, it wouldn't Pay Much!! Whats a Man to do but try and get Through the Job, the GM and Dispatcher are Thick as Thieves, and I Needed My Truck Making Money! And There was No Way I was going to watch an 18 Year Old Boy get His Legs Severed when I could at Least try and Stop it, which I did!! Nobody Said it would be Easy, Right!!Wink

Rich?? I guess we all have our own ideas on what can be consisdered rich......

Myself I have had four surgeries on my wrist, which have resulted in a 70% loss of range of motion, and a loss of strength of around 80%. And, they are still talking about doing a wrist fusion.

This has all left me with out my $55k job of 28 years. And even though I qualify for retraining under Montana Law WC is refusing to pay. Most importantly I can not do all the things I use to do before my injury! I can no longer row a drift boat, white water raft,play baseball, ride my mtn. bike, and I had to learn to flyfish with my right hand. Not to mention all the mental anguish, the depression, and the anxiety I have been going through for the last three years. My settlement for all this $ 35k. Finacally I will be broke in about a year as I can not even find a minuim wage job that I can do with my limitations.

The bottom line, I would give anything to have my old life back.

I feel all of us would love our "original" uninjured life back but it is not Reality. I am disabled for life and I struggle with this but I have to move on. I do draw SSDI but its a 1/3 of what I made in 2003. It is a tremendous help though and I am thankful for it.

I guess for many IW's it get down to the Question, Does one believe that WC disable you by the way they medically treated you?
I feel at on point early in my Injury A total disabled life could have been avoided if WC would have approvef the Kyphoplasty procedure but they denied it 3x but here I am disabled and living with my Injury.

I was in a car wreck in a company van. I flipped end over end. T12 was 70-80% compressed and split. I had a T12 Corpectomy 2 1/2 years later with a bone fusion
