Injured Over 2 years ago. Pain starting up again.
OK i had a work injury two years ago and was put out of ttd for 6 months then released back to work with no restrictions and before i could make it back i was laid off. I was diagnosed with nerve damage in my neck and bulging discs. The nerve damage in my causes my left hand to go numb very often and lately I have begun to drop things quite often. I contacted an attorney because now the Insurance company is giving me the run around about sending me back to the dr. I am meeting with the lawyer on monday, But my question is this. I am still unemployed as I will never be able to do the same job I was doing as it required me to lift 5-60 lbs continous all day long and working with my hands all day as well. Not to mention the fact that its painfulll. I just want to know what I will be up against when this goes to court, Am i looking at a possible settlement or award. They never did an IME on me either as they should have but at that time i was so overwhelmed i did not know one was required. I did not have surgery they did epidorial injections and sent me to pain managment and that was basically it and shoved me out the door. Any info would be helpfull. Thank You and god bless

at a hearing the judge will review the evidence linking your current condition to your work injury and will award or deny benefits accordingly.
either you or the carrier/employer can negotiate a settlement before the judge makes their decision.
