RE: Still Trying to recover from FCE
After I had my FCE I was in big pain. I don't at all agree with what the therapist said. Said I can push pull 20-30lbs I can't even grip anything to hold it to push or pull. Everything I did while I was doing the test was with my left uninjured hand. I don't think that should have counted. They should have let me do it with only my right hand. I can't bend my wrist how am I suppose to push something, I would have to push with my knuckles.
But I guess it is what it is. |

RE: Still Trying to recover from FCE
FYI
The ninth circuit court of appeals has jsut ruled that an FCE is in fact a medical test. This has significant implications about who receives and acts on it, HIPPA etc etc. This will likely lead to a big reduction in FCE's |

RE: Still Trying to recover from FCE
no but:
http://www.courthousenews.com/2009/09/28...t_Says.htm it has little to do with the merits of the plaintiffs case, more a lawyer semantic argument but it is now law at least in one part of the country. |

The link is http://www.businessinsurance.com/assets/...63104.PDF.
Looks like they are saying that an FCE as part of a return to work physical may be a violation of the ADA. |
