|
return to work question
if i return to work under light duty and over a period of time never fully regain use of my right shoulder and my orriginal job requires me to be able to hold my own body weight for periods of time and use large heavy tools which require both arms to use, can and does my employer have the right to terminate me for not being able to perform my original job.

If you get released to full duty and can't perform it, then you seek the treating doctor to make restrictions again.

Yes; Considering you have been released to unrestricted work. If you are released to a different work classification such as light duty and your former job requires medium duty, The employer can release you because you are not able to perform the required job. In my state of Louisiana, The employer does not have to hold your job or make you a job when released back to the work force. 2011 Lexus Convertible |

when going back to work and your company has a policy that wont let me take anything for pain except tylenol or motrin thats over the counter and they dont help with the pain is it right to be made to work in constant pain. they said that i can take it at home but they tell me i cant at work and if something were to happen and had to take a drug test then that puts me in a catch 22 situation that could get me fired. what to do.

ask your Doc and or case worker.....
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....
