Permanent & Stationary in Calif.
Hi everyone,
I have learned a whole lot reading this forum and thank you for that! I do not have a atty because WC is very cooperative. I am now P&S and the ins. co. told me to wait for paperwork. The doctor said leave open for future medical for life and the ins. co. agrees. I had a gangelion cyst removed from rt wrist but continue to have on going arm/elbow pain. The ins. co syays they will make a settlement offer based on future medical. Question one: What is a fair amount to except? I think I may be expecting too much. Question two: determined to be P&S on 7/21/09, should I be receiving some type of advance settlement payments? Thanks |

future disability benefits are based on an impairment rating. they can make advance payments if they have a reasonable idea of your permanent impairment. If they don't or it's unknown then they can't.
if they are being so cooperative that should have been explained when you asked. read the PD fact sheet http://www.dir.ca.gov/dwc/iwguides.html if you don't have a reasonable idea as to what your impairment is worth or what your future medical costs might be you should probably take the periodic permanent disability payments and leave the medical open rather then try to negotiate a lumpsum buyout (Compromise & Release).
