Need Help In TX

I was injured in June 07. I got an IR of 0.I had my leg broke and a closed skull fracture and 1 knee suregery in feb 08.I saw a nuerologist and on a report said I have memory problems headaches and dizziness. problem is that Insurance wont let me have another IR from my doctor so what do i do about this? 2nd question is The hospital I went to charged off a doctor bill on MY credit report because it wasn't paid by insurance.Insurance said they never got it and they wont pay it because its been more than 90 days.What can i do about this getting off my credit report.From my understanding workers comp cant be charged off on my credit.Last thing is that what do i need to do to start on my settlememt from the insurance company?Thanks for the help

disputes are handled by the comp court. ask the judge to order another IR.
make a settlement demand in writing; include payment for the doctor bill in the settlement.

Your absolutely right about WC charges. You are not to be billed for anything in regards to your injury, especially if the hospital knows it is related to WC. All you should have received was a statement showing what the charges were. It doesn't matter if the IC gets the bill the day it is incurred, or 6 months down the road. I had charges that went from March 08 to April 09 that weren't submitted till the IC agreed to accept my injury as work related, put me at MMI and started paying my IIB's. Nothing during the time that I was off work, but luckily I had short and long term disability through my ex-employer that kept me from loosing everything.

Do you have an attorney ?? If not, you need to get one NOW and have them file a contested claim hearing on your behalf and fight to get a second opinion. With an IR of 0%, there will be no settlement talk. In TX, you get three weeks of IIB's per percentage of IR. I believe that you have 90 days after the IC receives the iR report to appeal the findings. If you are outside of that time frame, you have a fight on your hands.

As for getting the WC bill off of your credit report, you are going to have to pull all three reports: experian, trans union and equifax and see if it is on all three, two or just one. Then you will have to write a letter to each company (as well as the hospital or Dr that the bill originated from) telling them that you are disputing the charge and want it taken off of your report. You need to send them certified return receipt so that you know that they have received your letter, and start the 30 day clock from the date signed on the return receipt. Make sure that you state in your letter that this is in the state of TX and that it is a WC injury and should have never gone to collections per TX WC law. If you haven't heard anything within those 30 days, you need to send a 2nd letter, same as the first, just let them know that this is the 2nd letter. If at the end of an additional 30 days, you haven't heard anything, then you need to contact an attorney that handles this kind of case.

I wish that I could give you some better news. But this is a system that isn't put into place to help the injured worker. Unless you know everything there is in the statutes and regulations, you are treading in deep water without the help of a good attorney.

I appealed the o% IR within the 30 days.I was fighting another knee surgery for months and then decided to ask for another IR which the IC told me NO. I went to a few lawyers and none of them will help because its been too long since my injury so i have no idea what to do now.Anyone know who i can contact to help me?Thanks
