Settlement offer on the auto
I received a letter from the attorney today with a settlement offer on the auto accident.

I injured my neck in the accident and according to the doctor I will need surgery on the future.

My attorney came up with the figure of $25,000.00 in the demand letter he sent to the insurance company.

The insurance company has made the offer of $7,500.00.

The are saying I went to the doctor with complaint of the neck
8 months previous to the accident. I did see the doctor with complaints of the neck/back and the MRI showed a tumor of the T12 bone marrow.
I went thru treatment and am now stable with that.

The insurance company is also saying another reason for this amount offered is due to having arthiritis of the neck.

I find this to be a low settlement offer and will refuse it.

Any thoughts..........................

you have to do what feels right to you and your lawyer....what did he say?

I haven't talked to him as the letter came today in the mail.

I do have unpaid medical bills that I will have to pay out of the settlement and in Kansas the attorney get 30% of settlement.

My doctor did tell me the damage to C-5 and the need for surgery is due to the accident. I have bone spurs on C-4 & C-6 related to the arthiritis.

Bummer if you can not do it dont....since the fusion the discs above and below the fusion have given way....my pm doc said it happens alot be careful

Is the offer just for medical??? or is it for medical and the damage to the vehicle????

THe vehicle has already been repaired.

The $7,500.00 will be for unpaid medical and settlement. The insurance company did say they would pay medicare any monies owed.

The difference between what the lawyer requested and the ic is offering is $17500.00. I would be leaning towards rejecting the offer, but I would speak with lawyer first. He/she came up with the requested amount for a reason.......

AQA I feel the same as you do.

I do have a doctor appointment this week with the primary doctor whom saw me for the neck 8 months before the accident, which later I was diagnosis with the tumor.

My doctor has been great about witting letters at my attorney's request. The letter he wrote has helped with receiving medical treatment and the right knee added to the claim.

I want to be fair with the insurance company when it comes to the settlement.

Jayne is correct about the weakening above and below the disc. That is what happend to me. My original surgrey was a single fusion in 2003. 2 weeks ago a new surgrey to fuse the disc above and below the original one. 2nd surgrey bills that i have seen are over 49000.00.

Cervical Fusion 2003, c5-c6. Herniated and damaged Disc L1- L4-L5 S1. Lumbar Spinal Cord stimulator implant 09-2008. Cervical ACDF revision with hardware c4-c5-c6-c7 Sept 2009.
SSDI approved 3-2010. NOW OFFICIALY RETIRED

I understand what you are saying.

Fusion may not be the thing for me as I already have problems above & below C-5 with the bone spurs on C-4 & C-6.

I will be asking my doctor for a referral to a spine specialist, I would like to know what the future holds for me in regards to the neck injury.
