My fiance is in the process of recovering from a back injury received at work. Two weeks ago he made an appointment with a physician regarding this injury. When he made the appointment, he told the manager on duty when it was and that he would need to be off that day. He reminded them a week later. He called in the night before and reminded the manager on duty that he would be gone the next day for his doctor appointment. When he went back to work the day after the doctor visit, he was written up because he didn't tell the general, overall manager he was going to be gone. He's never had to tell him before...this manager is fighting him every step of the way. They said he should have come in at 4 a.m. and done a partial shift until 8 a.m. and then gone to his appointment. With his back injury he can barely do the work as it is...he is maintenance. Is the manager right? Can they write him up for this? Can anyone point me in the direction to look for this in worker's comp laws? Thank you.

Well, when I go to WC appts. I have to sign in and sign out at the doctors office. That time is put on my Work Release Form, which is then immediately faxed to my employer. They in turn allot for travel time, and that was the only excused time off work that was allowed. I remember other employees being docked because they had an appt. right after lunch, and never returned back to work.

Also, employers are not responsible to pay you for your WC dr. appts. unless it is written as part of your employee policy or collective bargaining unit contract. Some employers do pay but like I said, if they are on the ball, they check the appt. time to make sure they aren't paying for non workers comp time off.

The time off may have to be used as sick leave or personal leave.

As far as who to report your absence to, that is an internal policy. Can't help you there.

It would help to know a little more about his injury etc, Is he back to work full or part time.
Are there any work restrictions? Why did he have to take the whole day off work??? some special test ? I am also from Illinois and there are a few others that may be able to answer your questions, But we could use more info.
