Hi everyone Its been a long time I know Iowa for 1171
Back injury the facets . neck surgery , but denied around time i said something about neck .. Now they want to settle ! court coming up within the next month . getting offers ... found out that i still have restrictions My side ime stated around 13% total with back at a low 3% What do u think is a good offer .. and since its been denied lawyer states that i can contimue with seeing drs and my insurance will continue to cover me .. What are all your ideas on this ... low ball 15'000 Love to hear a bunch of comments on this .. Im an oldies from here have been around for a few years . |

curious. where in Iowa?
I'm from Des Moines- went to school in Dubuque. some relevant questions: will there be a Medicare Set aside involved? I haven't looked at the PD calculation formula from Iowa but has the carrier had a rating done or is there just the one? what kind of med are you getting? how much longer? any surgery past or future? are you represented? |

only one rating no meds just over the counter c6 c7 fused dont know on the future possib have other buldges in neck and damage to center of cord ,back facets cant have much done with them . Yes i am I just think tis funny that its deneid but they want to settle ... just on the rating . never paid any medicene bills , or wage lost . close medical if i take offer Will my insurance still cover this or will they want their cost paid also . |

Hello Tweety00,
I don't know anything about your state. All I can say is what happened to me in TEXAS. I had fusion at L5-S1. when I came to the two year mark and was rated. I received 10%. That came out to just over $11,000.00 and I have life time medical for the injury and meds.. Being that each state and each claim is different. I really don't know how the info I posted can help. Hopefully someone here can give you some usefull info. In my mind, if you are represented. The attorney would be the best to answere if it is fair. Being that they know how other claims were settled. I wish you the best. Take Care 8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. The closed medical is a bargaining chip for the defence.

I understand that But my lawyer says since its a denied claim no go on open medical .. I tried that chip already ... Stated that since its denied that I will be able to continue with my insurance to get future treatment ... but somthing is nagging at me on that one .. which is why I asked for opinions

I just went through this same thing. My WC claim on my right arm was denied up to and until I was made MMI by a second Dr. At that time, the IC agreed that I had had an injury, paid all medical from 13March08 to 14April09 and settled with me. Which saved them a lot of money in the long run, as I never received any treatment of any kind. Just had to drive 238 miles round trip each month for my Dr to keep me out of work, until the end when they started doing diagnostics to see what my injury was. If you receive a settlement from the IC, they are basically saying that your injury was caused by your employment, thus it would become an accepted claim and they should be responsible for paying back your insurance as well as paying for any out of pocket expenses that you had to pay IE: copays and meds as well as for transportation if you had to drive the allowed mileage to see your Dr. If they settle, there is the possibility that your insurance will no longer cover your injury as the IC is stating there was an injury, but that there is nothing more that they can do for you. I would definitely check this out, as then, if any further treatment is needed, you will have to pay out of your own pocket for 100% of it. Tweety, If your own insurance has been covering your injury, then is WC going to pay them back? and will that be seperate from your settlement?
Here in Illinois when my claim was denied, my own insuranse paid for all Meds and treatment and tests. then it was a fight between WC and my insurance, nothing to do with my settlement. I also received a seperate check at settlement for all out of pocket expenses I had paid out. I would think that if WC is talking settlement that your claim has been accepted....... I also think your attorney would know this..........Mine did. Life isn't about waiting for the storm to pass. It's about learning to dance in the rain. |
