WHY!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

SO many people are injured and must follow the Workers Comp process. in the midist of dealing with, the trails and tribulation of pain, anger, hate and dismay, once the payment hit the bank accounts in a settlement for those who are forunate to receive a settlement. it seems people are more reluctant to respond, or follow up with the pros and cons of the settlement phase to educate others. This system needs repair why cant all injured workers create some logical form of rebelion. not only to be heard but seen in numbers we are the back bone to the work force.

It seems we accept the peanuts they Issue, My I/C sales were 9 Billion dollars which is posted on thier website. Most of the people I have spoken with are fair, most want to work and be compensated for there injury, if this is true what I said,why cant we just come together and fight. I now the I/C will not play fair, but I thought this was the United States Of Anerica!!!!!

WC laws and statutes are controlled at the state level not National. Each state is independent.

You read only the bad experiences because of the nature of most WC websites. Everyone does not feel screwed believe it or not.

Be strong and Be smarter than what you are working on.

You are right most of what we hear is just the bad but in the case of me and my wife both have been bad. But hers did not put up much of a fight to fix stuff it's just her employers WC and our lawyer both screwed us. The doctors told us she would need more surgeries later and our lawyer told us the best thing to do was settle because it would too hard to get open medical and even if we did they didn't have to pay for anything. And now they stuck us with the balance of her medical bills that WC didn't pay, even with it being written they were to. Her lawyer quit with the firm he was with and I know of atleast one other person he screwed like this. Talking to other lawyers about this is like talking to a wall. We had one that said he could get it taken care of but nothing. Why do we have laws that allow lawyers to do this to injuried workers and I'm just guessing here but I bet WC paid this lawyer under the table to screw us and save them money. Tell me if they would look at these cases it wouldn't be clear what some are doing. No not all have problems but I can point to everybody my employer had in the rehab department as having trouble settling. One guy needed open medical and was awarded it my the court. But WC told them they would fight this for years if he wanted to keep his open medical. They cut him a deal to drop open medcial and they would pay the award within 30 days. We all know how long the system lets this stuff drag out so it ALL works for the employer.
I think there are allot more people in the same boat as us they just don't find these websites to report it. In my wifes case we didn't know to look for them.

I understand "Free Bird" but workers comp upon injury I suggest the employer provide the employee with a generlized form of education. Ignorance in workmans comp may become costly to the employee and employer . The only thing I knew in workmans comp that I would recieve a check for 2/3s of my gross thats it. i knew nothing else. I broke my back, I began to educate myself with Maryland law, there I understood I may choose my own doctor, there I discovered my rights. My employer did not report the injury until 4 months later. I hired a Lawyer, my Lawyer educated me, I began to search websites for chat rooms, none exsisted, I discovered this forum and here i sit.
Why cant states Genarlize workmans comp, I do understand the cost the kick backs etc. ooooohhh i see this has nothing to do with the employee, but the employer to make money at all cost. This is why I ask for education of workers perhaps a 3 min spill when hired. Me I have be told some people have no idea of thier rights, they heal under medical care and return to work, I know personally 2 people that were ignorant to the concept it would have been 3 So when you say be smart thats interesting, I understand each state is differant and its national,it appears your point is slanted. I rather usr the open minded approach with anything is possible in a fight

My point is not slanted; My point is "the real world". Who is going to sit down and educate there employee about a IC? Most who have a Burial policy have no idea what they have. Most who have a whole life insurance plan do not totally understand everything.

Sometimes we have to figure some things out on our own. There will never be a law put in place where a 2 day or one week class is taught to educate the worker on WC laws. Sometimes we have to be smart ourselves at the time of incident. I knew NOTHING about WC and I am still learning 6 years later.

When you get a speeding ticket you are not signing the ticket as a admission of guilt. You have time to prepare a case if you want to fight for your rights.

WC is a blunt system period. It is there for the IW to help them get back to a workful place in the work force.

Its goal is not to get you healed to your post injury self. I know that is hard to accept as it was for me, but if you educate yourself as you probably have you know this.
Is it fair? To us the IW no but to the IC yes and we cannot fight a bear like this with a bb gun.

I think God everyday I have my life and I receive the medical benefits and Income I receive as a result of my Accident. I am closing in on a 6 year wreck anniversary that could have been my 6 year dead anniversary but my life was spared.

My funeral is preplanned as well as my parents and my husband and paid for.....I was taught early to be responsiable(even if I never learned to spell)...I carry insurance on all my kids and grandkids...But I never carried any insurance like Aflak or carried insurance to cover morgage or car if I got hurt...dumb dumb dumb.....everywhere I go to speak to people I tell them to carry Aflak or something simular because that lapse in judgement almost cost us our home....I was dumb in that I thought if I got up and went to work everyday and gave it my all if I got hurt my employer would take care of me....dumb dumb dumb......

;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....Smile

And... the only way you learn is through obtaining knowledge yourself.

Anyone who is waiting on there employer to explain the ends and outs of WC during employer orientation has not lived in the real world of Reality.
It is not going to happen partially because they do not know themselves about the WC system of there state.

I am happy Jayne you are prepare, My point is for the unprepare as stated before, Finance is never or has never been a Issue for me, this is however about others. and information to others. (83% of college grads are bad spellers)
