Mediation? Mileage?
I live in Iowa and have two questions?

1. Typically, how long does it take from Deposition to Mediation, and in the State of Iowa if we go to Mediation and dont agree on settlement terms can we go to trial?
2. I submitted mileage to be paid to me back on May 28th and still have not seen anything as of yet?

Regarding the mileage, we have sent 3 letters regarding payment. What should I do? I have spoken to my Attorney and doesnt seem to helping much except to say they will send another letter. My understanding is that they have 30 days from reciept of orginal letter to send me payment for mileage?

Thanks in advance for any help on this matter.

I cant help here but will share expierence with mileage. I am from wi so laws may vary. They have 30 days after recieving request for reimburstment. They played the same game with me almost 6 months later I got it...... They used the same excuses said did not recieve it or didnt recieve 3 faxes we sent them... Finaly we sent it by registered mail so they would have to sign for it and ta-da 28 days later my check was there...... Anyways your lawyer should be on the ball and if he aint maybe think about finding other conscil that puts you in thier best interest.............Good luck..

I don't think there is a "typical case"; many case take months - some even years depending on very many factors affecting the complexity of issues and seriousness of the injury. while there are no public statistics on duration of claims there is some statistical information available on their website

delays have increased since the budget has reduced the number of commissioners by 25%.
yes either party can request a judicial decision if mediation does not resolve the issue.
there are no non-legal alternatives outside of bringing legal action that can force a response.
you can write a complaint letter to the manager or your congressman. you can also file a complaint with your state insurance commissioner.
but there is no guarentee that either will work before the court deals with the issue.
you can change attys and get one that might push the issue faster.

I have had experience with WC not paying mileage within a timely manner allowed by law. Have your attorney file for the penalty money they owe you for not paying in a timely manner. I am not sure what your time limit is allowed by the state you live in but check on that. If they are outside of the time allowed by law you are entitled to penalty money. I received $2,000 in penalty money and they did not fight it because they were wrong and knew it. That was the last time they were late paying my mileage. Get busy and take care!

I recieved ANOTHER letter from my attorney today it was directly to my employeer cert mail demanding payment for mileage. I hope this is the last letter being sent!
