I live in La. and i have been on wokers comp for 2 years and i haven't heard anything from wokers comp. i have even had surgery a year ago and i hired a lawyer to take my case. i want to know how much myt case is worth with a stimulator in my back . I injured my left ankle and have rsd, neuropathy nerve damage,periphal nerve damage in the left ankle and i have a stim ulator in my back to control the pain in the ankle iwant to and my doctor said that i was permernat disable i had to retire off of my job with this injury i been on workers comp for 2 years and i can't get my retirement check until wokers comp settle my case. my surgery has made a year 8-4-09 and i want to know if anyone in la. can give me some infomation on how to calculate my injury and how can i find information on wokerks comp laws in la. how long does it take for your attorney to discuss the amount that your case is worth?

in order to determine the value of your permanent disability and any settlement, your atty and the work comp commission need an impairment evaluation. Your doctor or one experienced in performing such an evaluation should schedule one for you.
once an impairment rating has been done I'm sure your atty will be in a better position to discuss a settlement amount. you need to contact your atty or your doctor to find out when you will be given such an evaluation. generally once your doctor believes you have achived maximum recovery one will be scheduled. |

My doctor said i only have 32% movement in my ankle and since i had the surgery it's no more that he can. I just have to keep seeking medical attention for the rest of my life. to monitor the stimulator in back for the nerve damage. Iwant to know if you have permanent nerve damage how much your case is worth? He also said i will always have problems because nerve damage never heals.

32% motion in your ankle is not an impairment rating.Loss of motion is one factor in measuring impairment. how much motion did you have before the injury? what about weight bearing? atrophy? pain: where, when, how much?
there are a number of factors considered when determining physical impairment. an impairment rating cannot be done on a public message board. have you discussed having a rating done with your doctor or your atty? if you have a 50% whole person rating your settlement is worth more then if you have a 5 % whole person impairment. what is your impairment rating? It's difficult to calculate how much more benefits you are entitled to without knowing how much impairment you have. Not everyone in your condition or with your symptoms are affected the same way. an impairment rating calculates the extent to which it affects you and adjusts the disabilility amount to match. those with more disability are paid longer then those who are less impaired. impairments can be a difficult and complex idea to understand and each state has different ways to measure and pay impairment benefits. here is a link to North Carolina's rating guide. louisanna's is not on line but it will give you and idea of how complicated how ratings can be. http://www.ic.nc.gov/ncic/pages/ratinggd.htm |
