She has a Work Comp case, that is for sure. She was injured while working, even if it took place in a Chain Store. The Work Comp Insurance will place a Lien on the Chain Stores Insurance, to ensure the recoup the money they are going to spend to fix your daughter. You Attorney may wish to File what is called a Civil Suit on the Chain Store, or what is called a 3RD Party Law Suit. Either way, the main Insurance being Work Comp Insurance will have to be paid back their money first, before your daughter see's and money. Then, whatever is left over is hers. (((That is a general description on how this works))). Some States have discounts and such that may apply when there is a 3rd party Law suit. Your Attorney can explain all that to you or your daughter.
