Okay, so here's the latest. saw the surgon today and surgury is schedluled in 2 weeks. I know some of you have had this procedure and some of you are familiar with it. Do you think it's the right thing to do? It's been almost 8 weeks since the accident, and symptoms are getting worse. No improvement at all. Is there a chance of nerve damage the longer you wait, or has the damage already been done? Could she be in worst shape after this, or could the pain go away with the proper post-op things to do?
We also called workman's comp insurance today to let them know, but only left a message to call back. Dr's office said they'd take care of everything, but to call and let them know. Will she get paid while off work? Will there be any hassle with them to do so?
We also called the attorney. He said he'll talk it over with another personal injury attorney and let us know tomorrow if theres a case. He said it's sometimes hard to prove negelance for just a spill on the floor, so we'll see.

Pennilayne, your doing the right thing as of now. What you need to do for yourself and your daughter is to relax, pray, and help her stay with a positive outlook for her well being and such. Next, PLEASE let the Work Comp Attorney be her guide as to what too do, and what not to do. They will and should have her best interest in mind.

Yes, she should get what is called TTD checks soon. That will be 3/4's of what her weekly wages were before injured.

She has an Attorney now, so you should have been told by the Attorney not to call the Insurance Carrier now. (Ask her Attorney first for now on).

No one will know the outcome of the surgery till it has been performed and the surgeon gets a good look at what is going on in there. {You hadn't stated what type surgery she will have}?

in my experience traumatic disc ruptures have the most successful surgical outcomes. long standing degenerative conditions are the least successful.
if there is little doubt about the diagnosis then generally the sooner the surgery happens the better.
no. payments won't start until after the waiting period expires.

no one can predict whether the comp claim will be without hassles.
it's a serious injury with many payments and authorizations to many different providers with your employers money. the system is complex and ripe for errors and frustration especially if there are misguided assumptions on anyone's part.
the best advice is to be informed and be patient.
it is not the same as personal paid health care nor is comp law similar to negligence and civil law.
assuming it's the same as either can be frustrating.
it's the employers insurance, it's the employers claim, it's the employers doctor, and the employers money. most of the control is with the carrier/employer.

Oh sorry! Too many thoughts running through my head at once! It's a microdiscectomy of l5-s1. Huge herniated disc pressing on both sides. We really dont have an attorney yet. She was working, and while running an errand for her client, slipped and fell in a huge chain store because there was a puddle of something on the floor in an aisle. We'll see tomorrow if they think there is a case.

She has a Work Comp case, that is for sure. She was injured while working, even if it took place in a Chain Store. The Work Comp Insurance will place a Lien on the Chain Stores Insurance, to ensure the recoup the money they are going to spend to fix your daughter. You Attorney may wish to File what is called a Civil Suit on the Chain Store, or what is called a 3RD Party Law Suit. Either way, the main Insurance being Work Comp Insurance will have to be paid back their money first, before your daughter see's and money. Then, whatever is left over is hers. (((That is a general description on how this works))). Some States have discounts and such that may apply when there is a 3rd party Law suit. Your Attorney can explain all that to you or your daughter.

Hi Penny! My Surgery was a Microdiscectomy/Laminectomy at L5/S1, and would have been Very Successful had I not had unknown Scar Tissue Issues, this was My First Surgery ever, so I had No History to Fall back on. My Right Side S1 Nerve Root was Crushed, and the Scar Tissue Filled where they removed the Disc, attached to My S1 Nerve Root, and Encapsulated it while Still Crushed, so My Surgery has Left Me Disabled. Most of these Surgeries go Well. I Felt Real Good for a Short While before the Scar Tissue Issues Started, and at Her Young Age I think it could be a Successful Procedure, especially if She is in Constant Pain, and can't Function Normally! They May have to do Laminectomies, to clean out the Disc Material from around the S1 Nerve Roots, but I'm not Sure that if She needs them, they would do Both Sides. They May be able to get the Disc Material out without the Laminectomy, but Please Check on this, because Cutting the Disc at L5, along with a Laminectomy can leave Her Spine Unstable, You have to Remember this Surgery is on the Bottom Disc, and Helps to Hold the Spine Up! Please Remember those Second Opinions, it's Important to get Your Daughter Out of Pain, but You also want the Very Best Procedure for Her. Did they Mention any Hardware that would be Used with the Surgery?Wink

Hi! No laminectomy, just the microdiscectomy. No hardware either. We spoke with WC insurance company today. She will be getting someone new in charge of her claim. This person handles things like surgury and being off work. They'll also be the one to approve the procedure. They should approve it, right? God! This stuff is so complicated and time consuming! God bless all of you who have to deal with all this stuff along with being in pain! Im just the "personal assistant", and my head was about ready to explode!

pennilayne is your daughter a red head? and when she gets a cut or stitches that should have left a small scar has it left a large scar?
