WC in Florida many questions
I have a permanant partial disability for my dominant hand. I also have restrictions. Needless to say that I can not even return to the job I got hurt at. Nor other previous jobs I have had in the past. When potential employers hear about my restrictions they litrally shrug their noses and tell me they have nothing for me.
My ttd benefits stopped as of August 5th 09 will they send me money for my impairment rating I got or are they waiting to settle with me. I thought that IB started no later then 14 days after ttd stopped!?! I could be wrong.
Also since I have a ppd and they do want to settle. What all is considered?

yes florida will compute disability payments based upon your impairment rating. whether they will offer a settlement is unknown. settlements are not automatic.
you should contact the state vocational rehabilitation facility for help with another carreer

In Florida benefits for a Permanent Partial Disability are called Impairment Income Benefits. (IIBs) Once the employee has reached the date of maximum medical improvement, impairment benefits are due and payable within 14 days after the carrier has knowledge of the impairment.

These benefits are payable at 75% of the Average Temporary Total Disability benefit if the employee is not earning his pre-injury average weekly wage or higher. If the employee is earning his pre-injury average weekly wage or higher, the benefit is reduced by 50%.

Two weeks of benefits are to be paid to the employee for each percentage point of impairment from 1 percent up to and including 10 percent.

For each percentage point of impairment from 11 percent up to and including 15 percent, 3 weeks of benefits are to be paid.

For each percentage point of impairment from 16 percent up to and including 20 percent, 4 weeks of benefits are to be paid.

For each percentage point of impairment from 21 percent and higher, 6 weeks of benefits are to be paid.

The carrier does not have to settle. They do so in order to reduce their future exposure. There are many factors considered in settlement and different carriers have different philosophies and evaluate their future exposure differently. Everything is on a case by case basis.
