Still Hurting

I am from N.Y. I hurt my knee at work in 5/08 i had surgery in 7/08-Patella surgery I was out of work until April 09 (had an MRI done on knee in march 09 and they did not find anything wrong with the knee except some deterioration) in the patella a little arthritis when my Dr. said I could return to work even though I still had knee problems swelling pain etc.well of course my work said that there is no work now for me they are slow. So I went on unemployment, I have seen the Dr twice since than and my knee is giving me more problems it keeps on giving out still in pain and swelling, he has given me pain for the med"s but it does not help,for the past 2 months he has been trying to get approval from comp for some kind of shots that he will give me in the knee still no response from comp on approval for that.

Tomorrow I have another appointment with my Dr. and I want to ask him to put me back on comp because I know that if I did get a job I would not last long because of me knee always giving out example I could just be walking and than it gives out my whole leg gives out making me tumble I even wear a wrap around knee brace but it still gives out. I understand it is up to the Dr to put me back on comp. any thoughts on how to ask him or any other suggestions would be helpful.

Yes i do have an Attorney and they said they really can not do anything to help me about being put back on comp until the Dr says he will.
