out of work ....again
well i saw my dr again today, i thought he was going to give me permanent restrictions. but instead he took me out of work said unable to work. i brought the note to employer and they said ok. so i feel like i'm in limbo. i am still employed but can't work. second claim is contested so no ttd. i will try to use std benefits but unsure if they will be approved. my dr told me i will be unable to return to any kind of manual labor job (i build furniture) not sure where to go from here. my lawyer has mediation for settlement set for the 18th of this month. this whole process is scary.

What was his rationale for not giving you permanent restrictions that perhaps your employer could work with you on? Do YUO think that is the best course of action at this point ? Is there some imminent severe harm if working or is the Dr. being overly paternalistic to your potential detriment ?

I am just assuming from your post that you desired to RTW in some capacity.

they don't have any light duty for me, last time he put me on light duty work said not to come back until the restrictions were lifted. last time i saw the dr, told him i wanted to try it without restrictions, he gave me tramadol for pain and told me i could try working full duty again. i did try but standing all day is just too much. the sad thing is i love building furniture and i was told i need to find a different line of work.

With this New Prognosis from Your Dr., Maybe when You go to Mediation Your Attorney could Ask for a Second Opinion on Your Condition, and find a Dr. that can Place the Restrictions on You that will allow You to know exactly where You Stand, and what Type of Work You can do. Be Sure and Keep in Close Contact with Your Attorney, and I Hope they can Make things Clearer for You!! My Very Best, and Call Your Attorney, if Your Dr. said No Work, Maybe They can get Your TTD Started back again before the Mediation, this is a Change in Your Condition, and Your Employer has no Work for You. You May want to also Speak to Your Attorney and see if this New Evidence will allow You to Sign for Unemployment!!Wink
