Fusion of the ankle
I saw my primary doctor yesterday, he is an osteopath and has been on target with what the surgeon's have said with my past injuries.
I have been a patient of this doctor since 1991. I fell in 1997 and had 2 breaks of the right ankle. I didn't need surgery, and wore a boot on the foot for several months. I was treated by an orthopedic for the injury. I have been having lots of giving of this ankle with very intense pain (10+++) I now wear a brace on the ankle due to being unstable and being a risk for falling. Yesterday the doctor told me it is his opinion that I will need fusion on the ankle joint. He said I have arthritis of the ankle and my gait and back problems are contributing to the problem. To add to this I had an x-ray of the right knee because I am now having giving of this knee. This is the knee with the overuse injury with surgery 2007/meniscus & pica surgery. I am going to the hospital to get ther X-ray report on the ankle for my records this morning. I am not for sure what to do at this point, do I add this to the wc claim? My attorney tells me I need to but will I ever receive medical treatment if I do? ( If you know my history you know why I say this) |

Bummer, this is My Opinion Only, and I'll Explain My Reasoning in a Minute. Every Time Something is Added as a Part of a Claim, as Our Conditions Deteriorate, Opens up the Chance for the W/c Ins. Co. to Attack, and Open New Petitions to Review Your Medical, Your Meds. via a Utilization Review, and the List goes on. Unless, without a Shadow of a doubt the New Injury is a Direct Effect of the Original Injury, and can't be Argued by the Defense, My Attorney tells Me to Abstain from Adding, We can always Add Later if Needed! Case in Point: Opiates and Pain have Stopped My Body from Producing Testerone, and I am now being Analyzed for Possible Liver Damage, and I have a Cyst in My Left Shoulder about the Size of a Golf Ball that is a Direct Result of the Trauma when I caught that Heavy Weight, and We have Added none of these Yet, but if We feel We need More Power in Our Case, they will be Introduced, and if Approved, they have a Ton of Money to Pay Back to Medicare, and Me because I'm Paying the 20% Co-Pay! These are Aces in a Hole for Us, and We are Winning without them, but they are Documented and Ready if Needed! Adding, especially if there was a Break in the Past, is going to give the Defense the Argument that You are Starting to Add anything You can Find, even though We know Your not, if they can get a Judge to Agree, it could Harm, Rather than Hurt Your Case! As I said My Opinion Only, and I know You will make the Right Decision!!
Failed Back Surgery, Chronic Pain, Totally Disabled. Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!! |

Thank you both for your post and I was in hopes both of you would post a response. It is my attorney that said "Lets add it to the claim" last time I was in his office. I declined just as I did when I decided not to add the left carpal tunnel to the claim. I have been up front with work comp on my past medical and will continue to do so. I don't understand my attorney's thinking, maybe it is as you posted Still In Limbo "fuel for the fire to keep on the back burner" |

I thought I would update this thread with the information I learned this afternoon.
The results of the x-ray of the knee shows moderate narrowing of the lateral joint space. The injury of this knee was due to overuse and wc approved treatment. I had surgery 2005, pica and meniscus. The written report is being sent to my attorney. |

The right knee was an accepted injury by wc right from the start.
Right now we are seeking additional medical treatment. I Kansas to receive additional medical treatment the injured worker has to go back to court. |
