am i entitled to back pay
Hello everyone...it's been a while since I've posted. I'm in the State of Indiana. I had a 2-level lumbar fusion in Mar '08. Work Comp placed me at MMI April '09. I went for an IME which was ruled in my favor...says another surgery is needed. I'm not at MMI. Am I due backpay from April '09 when workcomp payment stopped? Any feedback is greatly appreciated.

you may be due retroactive temporary disability payments if you have disability authorization and have not worked during that period.
generally the medical evidence has to be ruled on by the comp court unless the carrier is willing to negotiate or restart on their own. |
