I know why it's taking so long
I spoke to the attorney today about where we are with the judge's decision.

My attorney was told over a month ago the decision was in only to findout that was not the case. (This is for treatment for the right knee, right carpal tunnel, and back)

The judge has some health issues and will be having knee replacement surgery in the near future.

My attorney says if the judge dosen't make the decision before the surgery date then my file will be given to another judge.

In Kansas the judge has 5 days to make a decision from the hearing date. The hearing was in Aprill.

As long as I pace myself I do okay with the knee & back, but when I have to do any lifting or much walking the pain is out of control.
Haven't been able to find anything to help with the nerve pain of the right hand.

Been trying to keep within my restrictions and be a good girl, but the wait is very annoying.

Bummer, It is like being pregnant, the closer ya come to your due date, it seems the longer the time becomes.
Hang in there , it will happen sooner or later........Good luck .

Tuffy thats what my attorney says, it will happen sooner or later.

Twice my attorney has talked to the judge about making a decision and I understand he dosen't want to push the judge as he has to work with her every day..

I am trying to have patience, difficult to do on the high pain days.

I want everyone on the forum to know how much you have helped me over the years.

Bummer, when I got the Original Judges Decision after 2 1/2 Years of Hearings and Battles, it Arrived 4-15-2008. At that Time I was Awarded Some Penalty Monies, and of Course the Defense Appealed, and so did We Over a Wage Issue, and a Portion of the Claim being an "Unreasonable Contest". There were 12 Petitions in that Part of the Case, and I Won 11 1/2 of them, and a Part of that was the Penalty Money, but they Appealed the Entire Ruling, which put My Penalty Money on Hold until the Appeals Board Approval. The Board Actually threw My Attorney and Myself for a Loop when they Actually did Give Me another Win with the Partial Unreasonable Contest, and it was Sent Back to the Judge for Review and Additional Penalty Monies, and also this would have Released My Earlier Penalty Money from 4-15. This got to the Judge in October of Last Year, We had a Mandatory Mediation Process that went No Where, One Judge had to turn the Case over to the Original Judge for Decision on the Penalty Amount if any and it's Now 7-17-2009 and I STILL have not Received My Original Penalty Money that was Upheld by the Appeals Board, and No Decision has been Made on the New Penalty Amount!! If You took the Time to Read All of this, then You know that I Truly do Understand Your Frustration, because I'm Living it Every Day Also!! Just Hang in There, the Sun will Shine, and the Clouds will Part!!Smile

Failed Back Surgery, Chronic Pain, Totally Disabled.

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!
