After 4 weeks my hand&elbow started hurting really bad.I was suppose to have surgery on my left but i ask the dr.why i was having so much pain he went and talk to me really bad he said i put you back to work in 2 weeks your was well enough theres nothing wrong with your hand and he would not even look at it,your not happy with your right what make you think i'am going to do your left i refues to do it and sent me home. alls went down hill ever sense.Went to 2 dr.he said my hands were worn out and i needed to get another job easy for him to say you do everything with your hands. W/C sent me to another dr.in April he said i had mild rsd it will go away on it's own put me in p/t for 2 times a week for 6 weeks for post opt c t surgey made things worse it started spreading. Your Case Sounds Very Confusing, and Very Complicated!! I would Suggest You Seek another Attorney or Two to Talk to about Your Case, You seem to have Both w/c and Labor Board Issues. Best of Luck, and Welcome to the Forum!!Wink

hi. i had 2 surgeries (lft and rt) on in 11 07 and 12 07. docs let me go back to work 3 08 as my employer was constantly calling to see when i could go back. i stayed in full casts on both arms from elbow to fingers for 6 weeks....anyway i worked until 7 08 when my drs took me off of work again...employers terminated me after 28 yrs..almost half of my life....hands will never be the same. i also suffer from ra, reynauds syndrome and fibromyalgia. what is rsd? i am curious. but you are right, your hands will never be the same i was told i would never be able to work at the same capacity i was before...if your injury was work related you should be getting comp? but you know that they torment you and drive you crazy in the process. take care

Even though you are comp, if you have disability benefits and they have been taking a portion from your check to pay for the disability insurance, you are entitled to collect your short term or long term disability. If you have had deductions taken from your payroll check, you need to contact your Human Resource Dept. and discuss this situation. It is different is you were paying a protion of the premium or if your employer was paying the entire premium. I take it right now you have no income but I have a funny feeling that you should probably be able to collect your short term or long term disability. They will pay you until WC decides to pay you and when they do with your WC back pay you will have to pay a portion back to the disability ins, company but in the meantime you would have an income. If your comp claim is denied then for sure you should be able to collect the disability from your employer as long as you cannot return to work and until you reach a certain age. The age depends on what your policy states as not all are the same. Call Human Resource and discuss this with them. If you do not get this straightened out, contact a lawyer immediately. Welcome to the forum and Good luck!
