Worker compensation qualification

I work in a workforce center, (one-stop center) helping job seekers find employment either because they have been layed off, have been injured and want to return to work, or a wide array of reasons. I have a customer who was working for a construction company in Minnesota. He was a contracted employee that worked when called. He received an injury (got something in his eye which left it swollen and blood in the white of his eye) His employer did not want him to work because of it and has not called him back to work for close to three weeks now. I know the person did not have health coverage with this company. He said he didn't think he qualified for worker comp because he was contracted and not hourly. He has not been to a doctor because of no health insurance and believing that he did not qualify for worker comp. I think he should qualify because he is an employee, albeit not working right now. I would like to give him good advice about this because I think the employer is avoiding his responsibility here. Can you assist me with resources where this person can go to get resolution? Thank-you

If your company is a type of employee leasing company then he would be covered under your company's WC. Otherwise if contracted with the construction company directly, theirs. Minnesota WC Customer Service 1-800-342-5354 or Claim Questions (651) 284-5032
