RE: Is this legal?
nah ya dont..............but really call the police and report the harrassing phone calls and stalking.let them know you are injured and unable to protect yourself..vary your route and time dont let them turn you into a recluse it is a big problem for us injured workers afraid to go out because of people taking our pictures and following us.....if all else fails find someone with a catfish pond or hungry pigs they will eat anything
;)Workmans comp is not a road you want to travel alone. You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life, you have come out ahead of the game.....

RE: Is this legal?
Disc, Welcome to the Forum, and if they are Following You via Air, and You are staying within Your Restrictions, it's much Better to Ignore them and if they want to Spend that Much, God Bless!! One thing My Attorney told Me when I was Worried when being followed was , "You're Disabled, not Dead!!" There are still things We can do even though We can't Work 40 hrs. per wk., so go Out and do what You have to do! I have been Followed Extensively for 5 Years Now, I even Caught One of them Today when I had to go to Lowes, and He knew I Nailed Him, but He still Continued to Follow Me!! I have been to 15 Hearings, the Appeals Process and won 14 1/2 out of 15 Petitions, and also was Awarded More by the Appeals Board, and even with ALL of that Surveillance, They could not Produce One Photo, or One Second of Film showing Me above My Restrictions!! As long as You're within Your Restrictions, Relax, I know that's Hard to do, I Hate it Myself,, but getting Worked Up won't Stop Them, so Live Your Life as You See fit, and Your Attorney will Handle the Rest!! Happy 4th.!!!
Failed Back Surgery, Chronic Pain, Totally Disabled. Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!! |

RE: Is this legal?
Thats the one thing I told my lawyer was to ask them to show any pictures or video they had of me because it would only make my side of this look that much better. That is why they will not even say they did any of it. It helps when they are following you to think of the money they are spending at that time doing it. My employer spent alot of money one time following an injuried employee only to find out he was back to work. One part of the company didn't know what the other was doing.

RE: Is this legal?
I had someone following me for a while also-on and off for about a month. They video taped me outside my house and where ever. In Michigan they can also video tape in your windows if you are visible and the blinds are not closed. When my attorney told me about this I was pissed like you couldn't believe. One morning I went out and I saw the video camera come up so I went up to car window and knocked to get the guy to lower the window. He wouldn't do it so I told him he was very lucky as I thought he had pulled a gun on me(I didn't really think it was a gun) then I pulled out my Concealed Pistol License to show him that I can legally carry a concealed pistol (I wasn't carrying at the time). He turned kind of pale and then I told him he was lucky that I wasn't a panicky sort because if I thought some one had a weapon aimed at me, who knows what would have happened. I didn't see him anymore after that. I never threatened him nor did I pull a weapon on him but it worked out well in the end.

RE: Is this legal?
Hi DiscDude,
Welcome to the forum. It is amazing what extremes WC will go through to try and get out of paying you or try to show that you are a fake. I know whenever My lawyer and I meet with anyone one of the first questions she will ask is.....Do you have any surveillance? The answer is always No. I put nothing past these scumbags because they would rather spends millions to fight you instead of paying to get you where you might be able to return to work. I also have back injuries, neck injuries and shoulder. I have been in WC for 10 years now. You have found a most wonderful group of people on this site to surround your with. Again, welcome to our forum family and take care. Cajun Hugsssssssssssss, MJC Lumbar Laminectomy L5 - S1, Lumbar Disectomy L 4 -5, Cervical Microdisectomy C-4 -5, Cervical Anterior Fusion C 4 -5, Cervical Anterior Fusion C 5 - 6, Lumbar Disectomy, Laminectomy and Foraminotmy L 3 - 4, Cryo Surgery Lumbar. --Ongoing Problems.. Permanently Totally Disabled. |

RE: Is this legal?
Hi DiscDude....I know they use lowdown tactics but how can they justify keeping a helecopter in the air until you come out? (not saying its not happening) you could be inside allday....also what are the odds they get your pic at the same time they rent/use a helecopter when your outside?....its possible but Im doubtful.....they may be getting pics from another area while your looking at the copter.....stay within your limits and you should be fine.
