FIRST I SLIPPED IN A PILE OF DOG POO IN THE KENNEL IN MID FEB 2009 REPORTED IT & WENT TO DOCTOR ONCE AND BACK TO WORK THEN END OF FEB 2009 I FELL OFF A LADDER @ WORK IN FISHY DEPT WENT TO DOCTOR! BY THE WAY FLOOR WAS WET FROM A LEAK UNDER SINK THAT WASN'T FIXED! THREE DAYS AFTER I FELL I TOLD MY STORE MANAGER I WAS GOING BACK TO THE DOCTOR THAT MY BACK AND LEG AREA WAS HURTING, 15 MINUTES LATER THE J/A FIRED ME SAID DUE TO ENVIROMENT CHANGES I WOULDN'T MEET THE NEEDS NO MORE I WORKED THERE FOR THREE YEARS SINCE THE DOORS OPENED (LONGER THAN ANYONE ELSE THERE)! SO I FILE FOR W/C I GET IT CHECKS COME FOR FOUR WEEKS THEN I GET A PHONE CALL IT'S THE STORE CORP. OFFICE THEY FIRED THE MANAGER & WANTED ME TO COME BACK TO WORK SO HAPPILY I WENT BACK I LOVED MY JOB AN ANIMALS AN CUSTOMERS!! WELL I WENT TO THERAPHY THREE TIMES A WEEK SINCE MARCH HAD MRI ON MY BACK 2 WKS AGO ONE ON MY KNEE TODAY WAS PRESCRIBED A TINZ UNIT FOR BACK AND I HAVE AT LEAST 6 MORE THERAPHY VISITS LEFT ! BEFORE ACCIDENT I COULD BEAR HUG A REFRIGERATOR AND MOVE IT MYSELF NOW I CAN'T EVEN PICK UP MY 10 LB SHIH-TZU WITH OUT PAIN!! DOCTOR HAS ME ON VALIUM SOMA'S LORATABS7.5 NAPROZEN AND SOMETHING ELSE CAN'T REMEMBER SAYS BACK MRI SHOWS A WORE DISK AND SWELLING IN BETWEEN TWO DISKS KNEE I DON'T KNOW RESULTS YET !! BUT EVEN WITH THERAPHY I'M NOT GETTING ANY BETTER!! IF ANYTHING KNEE IS WORSE IF I'M WALKING OR ON MY FEET MORE THAN 5 MIN. KNEE BUCKLES ANKLE HAS BECOME WEEK AN SWOLLEN AT TIMES EVEN MY WRIST SWELLS NOW AND IT'S ALLWAYS MY RIGHT SIDE {WRIST & LEG} BACK THE WHOLE THING HURTS!!! WELL I GOT FIRED AGAIN A WEEK AN HALF AGO FOR TO MANY CONFLICTS !!MY ONLY CONFLICT WAS I WAS ON MY FEET FOR 9 HOURS NO BREAKS AND I WAS HURTING AND I KEPT TELLING THEM I'M IN PAIN THANK GOD THE NEW MANAGER WAS THERE AN THE GUY FROM CORP WAS NOT SHE FIRED ME! SEPARATION SAID TO MANY CONFLICTS WITH OTHERS I SNATCHED IT UP SIGNED IT COPIED IT AN SHOVED MINE IN MY POCKET !!!HAHA CORP CALLED TWO DAYS LATER SAID I COULD COME BACK I TOLD THEM SORRY!! NO THANKS SO WHERE IS ALL THIS GOING??? WHAT IS MY NEXT MOVE CAUSE I AM IN PAIN EVEN THE PILLS ARE NOT HELPING MUCH?? First of All Welcome to the Forum!! If You are in Severe Pain, and the Meds. the Dr. is giving You isn't Working, and Your Knee and Ankle is causing You to Fall from the Discomfort, Please try and Contact the Dr. for an Emergency Appt., and if they can't fit You in, go to the Emergency Room! I am Assuming that You have an Open w/c Claim, make Sure You take that Claim Number with You to the E.R., if You don't have a Claim, tell them this is Work Related, and get the Care You Need!! As Far as Your Work Treating You like a Jack in the Box as far as Employment, I would Suggest, My Opinion Only that You Retain an Attorney that Works in the w/c Arena! It seems You are going to get the Run Around, as You are getting now in the Future, so You May as Well Protect Yourself Legally!! My Very Best to You, and I Hope things Start Looking Brighter!!
Failed Back Surgery, Chronic Pain, Totally Disabled. Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!! |

From reading the last part did they tell you to come back to work and you refused? If so that could be a problem. I might have read that wrong and if I did I'm sorry but if they told you to return to work and you refused my bet is they are not going to want to pay for anything unless you get a hearing and they are forced to. But even then if you refused work that doesn't look good for your side.

Manley, the way I read it they fired her AGAIN, and 2 days later told her she could come back to work.
Greengurl, If thats the way it happened, I would contact the labor board. it sounds like 1 person fired you and then another person realized they had no legitimate reason to fire you and tried to get you to come back instead of causing them grief. After being fired twice, i think I would give them some grief!! |

You are right or atleast that is what it sounds like. If it is those are two differant thing to fight, I think. As for WC I would think if they offered her to come back to work and she said no that is not going to look good. It something you may win in the end but how long will the fight be? Unless they are just going to change and be nice you know they are not going to pay, they are going to make them fight for the money. I could be completely wrong about it all but I don't know if WC will care about the whole story, just that they offered the job back and she refused.

It's kind of a sticky wicket, if she were not fired and refused to go back to work, then she is wrong. But if she was fired for any reason, I don't think she would be obligated to return. This is one to watch.

greengurl...everyone has given you such good advise. I don't have much to add, listen to all you've been given. I believe first you need to see a Dr. as limbo suggested. I injured 5 body parts. Have nerve damage in my back that causes my knee to buckle and my ankle to roll over and swell for months each time so I know how you feel. You just never know when you'll fall and being up a ladder is no place for someone like you. BUT in the world of WC you can't make the decision yourself as to whether or not to work without some problems. You need a Dr. to say this is a work related injury and that he/she needs to put you out of work. I agree that your employer is playing games. No one who is injured needs that back and forth crap. Take care of your medical needs and then hire yourself an experienced WC attorney and let them help you. They will be able to help you continue medical care, work with WC for you and also either take care of the games your employer is playing or send you to and employment attorney. Also as suggested , you can call the Labor board but I feel hiring an attorney will solve alot of your problems. Best of luck. God is never late. In the end it doesn't matter how many years were in your life but how much life was in your years. |
