Yesterday I had my first IME in Washington, DC. The doctor for my job said that my back pain was from mild spinal stenosis. He said that I had this before I fell over some boxes at work a year ago. He also said that the fall agrrevated the issue and my spine is out of line. In about 5 years I will probably need surgery/fusion. Arthritis has settled in my back now. Even though I had no pain in my back prior to my accident at work, my pain is here with a vengence. Would this still be considered a w/c case? He said that I need continued PT, core strenghtening and water therapy. I NEVER had back pain until I fell over the boxes backwards and landed on my butt - gracefully! I have 2 annular tears, but he said that could have been there before the fall. Well if it was, it sure didn't hurt until AFTER the fall. Go figure??? The pain shoots down my leg, my hip hurt and I have burning sensations in my b-hind. When it rains, I fell every drop!. Not sure what to do. Confused and ticked off too!

aggravations are considered a new injury and would be covered by workers comp.
File a form 7 with your employer if you have not already done so

Don't know when your injury was. But, if I were you, I would want a Neurosurgeon to take a look at you. For how in the heck can any doctor say you had a problem a year before you were injured is beyond me.

Get a good second opinion as soon as posible with a good Neurosurgeon.

I was first seen by a pain doctor and the national rehab hospital. He sent me to another doctor who wanted to do a discogram. The IME was done by a neurosurgeon who said I had mild spinal stenosis and had it before my fall. Now my atty wants to send me for another IME of their choice. The boxes I fell over (in a hospital) were left in the hallway for 3 days, and when telling the nurses to move them B4 someone gets hurt, I was the one who got hurt and this was witnessed by 3 nurses. I can accept that I may have arthritis in my back, but I have never had any problems before this happened last May (08). I have only taken 3 weeks off from work since the accident, and now the pain is getting worse. I am entitled to the maximum amount that D.C. allows ($1,228.00) per week at 100% temporary disability. I have driven over 1000 miles to PT and I was told that I am entitled to mileage too. Can I file this claim for mileage now, or do I have to wait until we start the settlement process (if it ever comes) ? Still green when it comes to w/c.

file for your mileage regularly -- don't save them up. it often takes weeks for them to process.

As far as mileage goes, do as 1171 said as sometimes they need the proof that you went to your appointment etc. before the adjuster cuts a check. I had an adjuster before that would wait till the 30 days before he would send me a check and now with this new adjuster I just email him my mileage and he sends it out the same day or within the week. He has always trusted me when I put my mileage in so he pays me instead of making me wait till they recieved the bill from the appointment to believe I really went to the doctors or not.

My other adjuster also would sometimes be so backed up that he would owe me 2 or 3 checks which means I waited 3 months before any payment. I had to tell my nurse case manager that the IC had not paid me my mileage and they were well past the 30 days which they could be fined for. I do not know about your state but I know that is how it works in NH. I think having a good relationship also with my adjuster has alot to do with how I am paid. He is really a nice guy and would do anything I ask of him and I think it is good if you can keep open good communication with your adjuster if you do not have a lawyer involved in your case where you can't contact them on your own.
