i'm not a texas work comp atty and don't know the caselaw on texas work comp fees. you need to talk to someone who is an expert on that.
the office of employee counsel does have experts
most states allow atty fees on all the comp benefits not just the ones paid after you got an atty. there are some states that don't.
if you didn't get a contract that explains the atty fees or the atty did not tell you how the fees would be calculated or you think your atty is lying to you or try to take advantage please discuss the details of your case with another atty or the dispute resolution people in the office of employee counsel.
use the contacts and help numbers on the many pages of posted information on your state's work comp website. there are people who do know--it's just a matter of knowing where to look and who to go to
