Question The Schoemal decision
Anyone familiar with the Schoemal decision? I have tried several searches, and googles and can find nothing on it.

Invoved in my case, based upon the life expectancy of my disabled child. (raises the present value of PTD benefits)

Hopefully someone here knows something about it.???>!!!

I have two children in the home, both disabled.

I will ask my attorney about this and let you know.

Annoyedtodeath, I done some searching under your State. It is my Opinion, that this is a Court case, in which a ruling for a Injured Worker had to support a Disabled family member. Child, or Spouse. I do also know SSDI does the same. In fact SSDI paid my daughter a check every month till she reached 18 years of age. And she wasn't disabled. I have heard of what your talking about, yet I for the life of me, can't remember the term used. But also, each State could have it's very own term. Now I'm wondering also, if the spelling is correct. Call your State Hotline, see if they know, and let me know. Don't forget you can go to that other site, go to Illinois and ask Marc. In the mean time, I will dig some more also.

Was just wondering if this is a federal ruling, ( case) I have a friend on SS and he has a son who is also receiving a check from SS and he is only 13 but has ADD, and just started getting checks when his father did.

Thanks for the input guys and gals. The word schoemal was in the email that my attorney's para-legal sent to me, so I figured it was spelled right.

Bad Boy you are probably right on the money with your reply.

We tried to get ssi or ssd for my child years ago. We were told that they go by the parents income and we made too much, so she could not qualify for either. She is now 18 and I have an attorney for her, to help get her on ssd.

Annoyed, That made for some very good reading and Knowledge. Thanks for sharing.

Being this was a Supreme Court case and ruling, Does that not make that a Federal case? And would effect all future cases of such.
