I was hurt initially at work the re-injured at home
Hello,
First of all great forum. My problem is that I slipped a disk in 2005 at work. I was out for a week apparently covered under Workers Comp although I never recieved any paperwork but I was paid and used no sick days. Fast forward to Sunday, May 17th 2009. I slipped same disk at home doing nothing but getting up from a chair. I went to the ER on the 18th because I just couldn't handle it anymore.
A few questions:
Would this not be a Workers Comp case as it is clearly a reoccurance of initial injury?

HR sent me FL papers but the ER refuses to fill them out even though they were the ones that put me out for a week?

I am in NJ. Thanks

no not workers comp.
aggravations of prior injuries are considered new injuries.
you have a new non-industrial injury.
