claim?
I was hurt in TX. the tool pusher on my drilling rig took off a safety switch resulting in me getting hurt. i recieved benefits for one year. My original lawyer said i cant sue bc they had workers comp but now ppl are saying its an OSHA thing and i might be able to sue? am i able to sue the drilling company?

sure you can call OSHA on them...when my husband was hurt because of a safety issue we called OSHA and they were given a fine....But OSHA gets the fine money we didnt.....

is the drilling company your employer?
was there a safety violation?
you can sue a third party but workers comp is entitled to get reimbursed for its costs.
many states allow extra benefits if employer violates safety laws but a texas
lawyer would be best resources for that information.
if you don't trust your lawyers advice you can change anytime.

Of course they would. They would send someone to the site to check up on how their are handling their safety. No matter how long ago as there was once a problem there at one time and there could be a problem there again if no one is following their safety plans. When I worked in construction before being laid off all it took was one incident from a job site nearby that something happened and OSHA would go to all the nearby sites and checkup on them within range.

I made a formal complant about safety where I work which means they were suppose to show up on site and look into the problem. Spoke with them on the phone and overnighted the signed complant so they could get right on it. They decided on their own to not do it that way and only called the company and asked for a written report within 30 days. So much for OSHA caring about the workers. I will never call them again
