I live in Louisiana. I applied for ssd. I have my work injury plus 4 other medical conditions. I am waiting on w/c to restart payments or settle. If I am approved for ssd, how will that affect my w/c payments or settlement.

You may need to have the work comp insurance set aside money for the work injury. This is called Medicare Set-Aside Fund.

You can receive both (SSDI and WC) at the same time. The SSDI amount will be offset so you collect a total of 80% of your wages before injury.
8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins. Soilders died for our freedom. |

Hi, I noticed someone mention set a side for medicare. I was wondering what this means. I too have applied for SSDI. I have a hearing in late June. I have a WC case that has been ongoing since the injury date of April 3,2006. We have paid for everything out of our pocket. well I emailed my lawyer to see if they have a settlement offer from my past employer and he said they have come to an agreement on the medicare set a side. I didn't know what it all meant. See I have to have another major knee surgery. But i have to now wait until we reach an agreement. We just can't afford to pay for another 1. 4 is just too much. And I have not worked in over 3 years now.

The medicare set aside is to keep the SSA from paying for future medical care for the injury and have the IC pay for it. by paying in advance and having that money set aside for future use towards the medical care for the injury.

Don't worry, Medicare won't screw themselves....they don't like to have to pay for an injury that is not their responsibility. I believe the set aside amount is disclosed near settlement time. Does anyone know how this set aside works if wc denies all medical treatment since 2006 even on the approved conditions?
I just got an award letter for ssdi and didn't even think about this part. Thanks. Kat |

medicare normally doesnt start for 2 years after the approvel date.....
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....
