hello,I went 2 the dr. wed and she told me I cant return to being a cna because of my back. she gave me meds and told me she can do more therapy and shots but if my pain cont. my disability form say perm. dia. fron Cna position, found out the same day my employer term. back inNov. after i was off for 12 wks I have not recieved anything from them stated i was not employed there. I called Corp. and ask them the I qualify for short term dia. back when i was employed the mgr. told I should be and she will get my files and work on the case to try to get my benefits. I filed for unemployment due to term. can I get benefits. still from unemployment even if my dr. said i cant work as a cna anymore. so basically she is telling me to look for work doing no lifting at all,come and see her in 3 mo.

Have they been paying you to be out of work up till this point? If so and they do not have any light duty then they should still be paying you.

carpal tunnel recurrence/ neuropathy / RSD.

no my atty is fighting for my medical bill to b paid and my lost wages for 1 yr I will see if they will pay me the short term tomorrow hope everything goes fine but the fired me in nov even corp. dont have a copy of my term papers

Have you not kept in touch with your place of employment?. or thought it strange they have not contacted you , I would have wondered, Have you been receivng WC benifits,?. When did you retain a attorney?.

no never recieved wc benefits was on light duty then after 2 months got a atty then i contacted my own dr and she took me off work until now she told me i can never return to my position before due to my disc problem from injury. i recieved therapy through my employer before my dr took me off work then my dr ordered the mri and saw problems with my disks bulging,flattened and 1 leaking.arthritis

everytime i contacted the employer they will say i was still employed i recieved a christmas and my sick days ck. in dec. my sisters work for the same employer and they told me in jan they took my name off the schedule.

Then if you have not received any type of termination notice , and the Co has no record, you may still be employed, just because they took your name from the schedule, may not meen you were/are terminated. I would have your attorney call the employer or HR dept and find out before you try filing for Unemployment......
