ok, i'm in Mi i been off work since May due to a back injury i have a rupture disc, a flattening disc and 2 bulging in my lumbar area i work as a CNA @ a nursing home i have not recieved any monetary benefits for anywhere. paying for medical out of pocket.My attorneY was @ A Pretrial yesterday he didnt return my call but i call the board and they told me its a triail date set for june what happen @ trial do the pay my benefits and medical or what. dr has not released me back to work yet due to the proper treatment i need just apply for medicaid to help me pay for it.but what due i do about income do i file unemployment or sign up for some stat asst.

Have you seen a WC Dr. and if so what was the outcome of that?? Was there no short term disability available from your employer?? Are you still employed by employer?? Sounds to me like someone has been gragging their feet!

yes i see a wc dr I found on my own after seeing their drs from occupational med..the wc dr took me off work order a mri found some problems and she gives me meds but she need to treat me with therapy and more test but workers comp don't want to pay 4 it. i see her tomorrow i just received medicaid yesterday so now she can treat me.i think the job has short term disability. Do i contact my employer and ask. i dont think i'm fired yet. i called then last month to see they told i wasn't.

I would ask the employer about the short term, but it has been almost a year now and I'm not sure that you can still get it. If you are still an employee, you would have a hard time getting unemployment because your out of work due to a work injury. If the WC Dr. took you off work, I am assuming that either the IC has accepted the claim or a judge ordered them to. In either case, if the IC is covering your medical you should have been getting some wage replacement. Others with more knowledge will be along soon. This is just my thoughts.

no the ic is not covering anything yet i dont know what went on @ the pretrial yesterday still no response fron my attny.

Why did your employer not automatically start your LTD after the time period was up and you still could not return to work?

Was your injury reported to WC when it happened or did some time pass by? I think it's odd that your injury was almost a year ago and you just had a pretrial yesterday.Is your employer fighting this claim, saying the injury did not happen at work? If they were jerks I think thay would have terminated you by now. It just does'nt make sense to me that you have gone a whole year with no income from anywhere, and a lawyer is ok with that.Good luck!!

I filed a claim the same day as the injury they sent me to the er and took me off work 4 1 day and light duty with sitting restrictions for 3 months until I contacted a attorney and my own drs.and recieved a Mri thats when I was put on no activity at all. since may. i'm trying to find my employee handbook now to read more I keep leaving messages for attny he dont call back he left a message a month ago and said the employee atty did have all their papr @ the pretrial in feb now they had another pretrial controlled date yesterday now the trial date is june.
