[/color][/b][b][color=#008000] I am 32 yr old female who was injurired at work in late 2007 and later in 2008 again. Work place was a hazard. Ok here are the facts.
I fell in late 2007 injuring my neck and back. I told my boss/owner and he told me that if I filed a complaint he would fire me, he that he would not cover it. Later I find he has no workers comp insurance and he is incorporated and has more than 1 employee. Later in 2008 I fell again hurting my back and neck again. Told him and again he said that he would fire me if I turned it in and that he would not pay for it. December 2008 I had surgery and returned to work before the doctor released me, we had an ice storm and I fell and busted my surgery site open. He would not pay for this either and told me again he would fire me. December 4 2008 I was using my car to do work errands and was in accident, a semi ran me off the road and I had to slam on my breaks which slammed me forward, hurt my neck, pushed the stirring wheel into my chest and ribs. I reported it to the police and told him about it, he said if I filed he would fire me and he would not cover any medical pay or repairs to my car. I did see the doctor on cases and I have herianted disc in my neck but I can't remember if I said it was from and injury. Can I sue him for my medical bills? Also why working for him he was very harsh man and I developed panic attacks and hated going to work, he sexualy harassed me. But I needed a job to pay my mortgages and jobs are hard to come by right now. Well any ways he fired me on March 16 because I was in the hospital, said he needed a someone who was not a fat ass sick person. What should I do, I have consulted a lawyer and we are waiting for all the medical expenses and records. what happens if my private insurance paid for it? I am afraid. Thanks |

First off I am sorry to hear about your injuries. Second It is a shame that you stayed at a place of employment where you were abused just because you needed pay and were harrassed that way. The first thing I would do is get a lawyer because this man should be fined for all that he has done to you. Does he still have employee's working for him now? If so, he is probably treating all them the same way and abusing the system.
He should have reported and YOU should have reported the injuries to the WC IC when they happened. So I would get a lawyer and start there because lord only knows what he may be doing to the other employee's he has there now or what might happen to one of them if they were to be hurt. Also he should be posting by law the workers comp. law someplace in the area where it can be seen by all at the place of employment. He can be fined for this if he has not done so. carpal tunnel recurrence/ neuropathy / RSD. 1/29/07 injury date. Permanent. PIR settlement 8/4/08 10% |
