Am I eligible

I hurt my back on the job several weeks ago and manager took me to the ER for treatment, but they didn't do any x-rays. I was on light duty for one week and then went back to my normal position, which requires heavy lifting. I've now injured it again and had x-rays done by a chiropractor (at the request of my medical doctor) and he's indicated I've got long-term issues and is still suggesting I not return to work. I spoke to my employer (State of Kentucky) who suggested short-term disability as an option, but this will only give me partial salary reimbursement. They are saying that I'm not eligible for Worker's Comp because I came back to work full-time after the injury. Is this true?

No it is not true. You are allowed to try and work, in fact it is better to do that for you and the employer. If pain aggravates the injury, the process just continues.

Thanks for reply. I didn't think they were being honest with me, so will get back to Human Resources Dept to fight it.

If you've had a new injury file a new claim with a whole new entitlement to all benefits.

You injured your back at work and you should fill out a form or when you first injured it. Did you do that? If not you should have. Even when you went back full time on light duty. Now that you re-injured it and you are going to be out of work you need to make sure that a form is filled out for WORKERS COMP and that they put the paperwork through as such. This is not short term disability if you hurt it at work. There should be a posting in your work place that tells you the insurance company for workers comp. that your company carries somewhere in the building where workers can see it at all times. I would look for it if I was you and find the name of it. They should be paying you for being out of work.

At the top of this page where it says " workers compensation.com" you will see " state Info". Just click on your state and you will get all the information you need to know about your claim. Good luck.
