can they fire me? ny
This is the first time i have really hurt myself on the job and I dont know how this works. I injured my back about 2 and a half weeks ago and I have been seeing the company doctor. The problem is my back is not getting any better, yet the doctor won't pull me outta work. They told me today that the reason they won't pull me out is because if they do the companys insurance will go up. They still have not taken an x-ray or anything of my back. They just assume it is a lumbar sprain and a thoracic sprain.
Now my problem/ question is I wake up in the morning barely able to move, needing assistance from my fiance to get dressed. I called in today because i was in too much pain to go and sit or stand all day. If I call in another day can they fire me for missing too much time?

we don't know your state and the rules are different for each.
without a doctor's approval for being off work you are vulnerable for termination.
most states allow you to get a second medical opinion or change doctors.
without knowing your state there's not more more I can advise.

if you are in that much pain go to the ER.. state it is a work injury...and make sure it is filed...Most back injuries clear up on their own. some dont and waiting around can make them worse....Again it sure would help to know your state

;)Workmans comp is not a road you want to travel alone. You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life, you have come out ahead of the game.....Smile

If your being told you can work, and you keep calling off, they do have options that you better talk with the employer about and quick.

thats what the told me pulled muscle, then DDD, then this, then that,to end up with fusion and nerve damage that cant be fixed. You need treatment,x-rays and a mri with and with out contrast.....Then if they find nothing thats good for you as you dont want back problems the rest of ur life or fusion, trust me you dont wont fusion.best of luck and i wish you well.

Each day is not a rite,it's a given.

RE: can they fire me? ny
I would think you could be fired if you keep missing time at work. If you cannot seem to get any xrays done or get any treatment of any kind and you are in alot of pain I would go to the ER like Jayne said and tell them it is WC and they will at least do a Xray for you to have and then get a second opinion from a doctor that WILL do something. What type of work do you do? Because with back pain I do not see how you can even work at this point without being on at least light duty or being out a few days to recoup maybe.Depending on the situation.

PS.
You do not want to KNOW what I would of said when they told me they would not take me out of work because they were afraid of the company insurance going up........I cannot believe they even said such a thing to a person that is injured. That they care more about their insurance rates than they do their employer. That should tell you something right there.

carpal tunnel recurrence/ neuropathy / RSD.
1/29/07 injury date. Permanent. PIR settlement 8/4/08 10%
