Injured in NV live in KY
Hello. I recently had an injury in NV and I am currently residing and needing a follow-up appointment in KY. However, I can not find a single office in my area that will process out of state workers comp claims. The insurance company is providing absolutely no help in locating a doctor for me either. I really don't want to hire a lawyer, I just want to make sure that I am healed. What options do I have? Thank you all for your help!!

Do you have personal insurance?. If so you can try using that and let the ins co and WC fight it out later.
Make sure you get copy's of everything and that the Dr knows that you have a WC claim, but are using your own ins.

Wow! Thank you very much for the super-fast response!!

I do have personal insurance but have been hesitant to jump on using it to avoid billing issues and/or interfere with any possible legal action that I may persue. Do you see any issues there?

As long as you have been clear to your physician you should not have a problem. Did you receive treatment in NV? You may want to contact the NV Workers Comp Department to see what is required of both you and the insurer in this situation. You may also want to speak with an attorney who could better advise you, but if Nevada is the state of record no Kentucky attorney may want to touch it. You might need to consult with a Nevada attorney.

Another question; does your insurer use an MCO? Nevada's selection of physicians and chiropractors are governed by NRS 616C.090; except in emergency, if the employer's workers' compensation insurer has entered into a managed care contract or health care service provider contract, the injured employee must choose the treating physician or chiropractor or health care service provider according to the terms of the contract. If the insurer has not entered into such a contract, the injured employee may choose his treating physicians and chiropractors that DIR has established. If the injured employee is dissatisfied with his initial treating doctor, he may choose an alternative physician or chiropractor within 90 days after his injury.
