And my attorney has already said if he dosen't like the results of the IME he will dispute it in court since the order reads:
"The ALJ pursuant to K.S.A. 44-516 appoints DR. XYZ as a neutral physican to examine and evaluate Claimant's right knee, right upper extreminty and back. Dr. XYZ to make treatments recomendations, if any. If no treatment is recomended, Dr. XYZ is to offer rating and recomendations" |

how did the upper extremity become involved ? Had you been using a cane or a walker BK ? Sorry for redundancy but I dont always follow all the threads.
I have a friend here who has a tethered spinal cord from failed back surgery then a SCS infection. Because his legs were always giving out he has had to use a quad cane but is so unsteady on his feet that he has to really fight with the cane to not fall and the excessive forceful gripping has led to CTS in that hand which is now part of his claim. |

Cycler, that is just the case here. Knee then total knee, use of walker, then a cain, falls or almost falls at times, other knee needs a replacement, Gait is not proper. That's bummer.

most IMEs consist of a Dr. pretending to read your file squeezing your hand and bouncing a rubber hammer off your knee and saying go back to work no restrictions....Hell I could do that.....Bummer all the IMEs I had were just like above EXCEPT the court one he found it all and didnt have to ask permission to run any test he wanted as he was court appt...he ran 2 emgs r and L,2 disk o grams cervical and lumbar....with MRIs after both disc o grams.....he sent me to the best pain doc to have these done......just do YOUR homework and have every thing wrote down that hurts or doesnt work as it should

I leave early in the morning for the court appointed IME. I have lunch with my friend the injured nurse today and she looked at the forms I have been requested to complete for this IME.
I will post tomorrow when I return home. Bummer Knees |

It has been an interesting day, and I am so happy my friend the injured nurse went with me to this appointment, she saved the day!
My friend is a RN and a physical therapist and understands the language of the medical community. It started with the PA asking questions, and there was a miss-communication as I was giving answers that were frustrating tthe PA. My friend realized what was gong on, jumped in and clairified things. I learned that no where in my medical records does it explain that I am hearing impaired. The PA would speak to me while turning his head in the other direction. Dosen't work for me as I read lips. The PA asked several times, "Why hasn't your medical been taken care of before now?" my friend replied, "Because it's work comp" the PA was upset with the lack of medical care I have received. The ortho came in the room and visited with me, he said I can not say in a court of law that the carpal tunnel is due to your work comp injury. I am going to give "them" insurance company" the carpal tunnel. (You called it Bad Boy) On the right knee the doctor said it wasn't an issue since it was already an approved wc injury, he did feel futhur treatment is needed and recommends 12 weeks of physical therapy and shots, to remove the fluid in the knee and to replace the fluid in the knee, also mentioned an MRI. On the back, the doctor asked several questions, he asked when I was injured, did I experience any pain in the back area. I told him yes, and the complaints are in my medical records. I must have said the right answer because the doctor said he was going to recommend treatment for my back. Physical therapy and ESI's were mentioned. The PA had also checked strength & reflexes. Nice Bummer, and glad to see it was the Doctor more then the PA. Saying you need treatment is good. Hopefully it won't take long to get neither.

The doctor's report will go to the judge, then another hearing will be scheduled, decisions will be made on the doctors or doctor providing treatment.
Then the judge will make a decision and I will be notified by mail of the decision made. I don't know how involved the decision making will be.....both IME doctors, and my doctor says the back is related to the origional injury. One of the three doctors says no treatment is needed. It was questioned today if problems of the knee are related to the problems with the back or wc knee injury, or both. |
