[size=small][font=Times New Roman]Hi everyone!!! I'm new to the forum, so i hope someone can help me!!!!! I got injured on the job, March 2008(back injury). I followed all the steps in order to get W/C. I was approved! Now, the w/c doctor put me on "light duty work" but the company, has a policy on "no light duty work". After a while, W/C started calling the w/c doctor. Complaining about me, being out so long for my injury, so the w/c doctor release me back to work. I had 2 take a test for the company, when i returned (to see if i was ready to come back). I failed their test, but they still kept me on the floor to work because they were short-hand on the floor. After a few hours of being in pain and not being able to do the job 100%, the company allowed me 2 go home/ making an appt with the w/c doctor again. The w/c doctor STATED," she know i wasnt ready to go back but yet she had to follow the steps when working with W/C" and she referred me 2 see an orthopedic surgeon. So, my benefits with W/C started back up. A few months later I started getting harassing phone calls and threats by the employer (that i will be fired or I needed to quit). I would received several calls a day. When i returned the calls. I was told, flat out that i needed 2 give a 2week notice(the employer also stated, that they "dont care if i retain a lawyer, because it was a state job and even if I sued them it would still be on my record that they fired me and I would never been able to work for that state again, due to them firing me. So before i know it i gave a 2week notice. Not knowing I needed to get a lawyer( I had no clue!!!!) I didn't contact a lawyer and at that time I didnt know if I needed 1. W/C still contunied my benifits and i still kept my appts with the orthopedic doctor. By this time i got a lawyer and told the lawyer everything thats was going on. Months laters I got MRI done ( i have L4 and L5 disk out of place). NOW, the orthopedic doctor kept telling me i needed to be in some type of light-duty work active and also due pt(phsically thep). I have that in writing. He then referrals me to see a spine surgen who at that time did not look at the MRI x-rays that i brought to his' office. He stated i can go back to work w/o any restrictions. The orthopedic doctor disagree any he kept me out, but on light duty. I found a job ( as a sitter, just sitting with ppl who are disable, that was not disobey any of my doctors' order) that was NOT full-time or part-time it was PRN (mearning-as needed work), and the company was willing to let me do light duty work with their company. So!!!, i took the job, not reporting it to W/C or my lawyer because he never told me i need 2 let him know.. NOW!!! W/C is stated that i comitted a fraud and now is building a case against me. W/C is stating that i work a full time job, while recieving benefits from them, and that the doctor had release me w/o any restrictions (which is not true). What do i need to do or what will happen to me? I have not done any PRN work in months. Can they cut my benefits due to this and press chargers against me? I'm still up under the care of my w/c doctor-who has me on light duty work and I'm also receiving long-term pain management. I have no income at all and I have not work on any job since Oct 2008 and my benefits was cut in Jan 2009. I dont have a clue on what to do or what will happen to me. My lawyer seem like they are lost in this matter. HELP!!!!! I'm in GA, if anyone know how W/C laws work here.... Thanks

You need to get a lawyer, right now!!! If you worked and received pay then the insurance company had to be notified so they could have adjusted your pay. Did you commit work comp fraud? I don't know Georgia law but in my state you would have.

Old Man's Info. to You was Very Good, You need an Attorney, and Quick! By all that I know of w/c, if You Worked and didn't Report it, even if You Followed Your Restrictions, it could Surely be Looked at as being Fraud. If they have Clearly Stated They are Starting Proceedings on You, or Building a Case of Fraud, You are going to need an Attorney's Help to get You through this. As far as them Pushing You to Resign, You May be able to come back at them with Possible Discrimination because You are Injured and they are using that against You, and also Harassment, but these are Questions only a Good Attorney can Answer for You! My Very Best, I Hope All Turns Out O.K., and You get the Help You Need!Wink

Failed Back Surgery, Chronic Pain, Totally Disabled.

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!
