RE: Vocational Rehab
I may have gotten the wrong impression. It appeared to me that the carrier was trying to keep the rehabilitation option going despite the conselor failures. You are saying that it's the other way 'ound. the carrier is road blocking the VR counselors. seems to me it's time to have the comp court take a look at what's happening.
can you get a court date?
there should be earlier copies of you employment history with you or the other counselors-easy for your atty to send a copy.

"If vocational and medical evaluations determine that your injury prevents you from ever becoming gainfully employed, you may be paid a monthly pension for life. However, this type of “non-statutory” pension may not be payable if you are able to return to work."

If it's been three years and they haven't gotten you into a job maybe you're entitled to a pension

RE: Vocational Rehab
Just a question?

Your State say's no more then 2 years for Voc Rehab?

(A vocational retraining plan includes a job goal based on your skills, interests, and medically documented limitations. The plan can include schooling or on-the-job training and cannot exceed two years’ duration)

RE: Vocational Rehab
1171 and Bad Boy...Thank you so much for the links. I will do some reading and will contact lawyer with some questions.
I am in vocational rehab since Sept. 2006...these is the second firm what claims adjuster hired. The previous firm recommended pention in 2007, claims manager didn't like it, so she fired this firm and hired the current one. This firm keeps assigning different counselors to me. They reach the limit what w/c allows to pay, so they reassing my case to a new counselor, who is working for the same firm and they start all over. They keep sending same JA's to IME doctors, who of course concur, than they send it to my own doctor, who doesn't and the cycle starts all over again.

I had three IME's just a few days ago, one with same doctor as eight months ago and probably all concur. They send it to my doctor also, whose bill they are not paying and who is not allowed to treat me, only to fill out paperwork for voc counselor. They are trying to catch him off guard, my claims manager keeps bombarding him with letters hoping my doctor gets tired of this and agrees to release me.

Thanks again for the excellent links.

katicabogar Wrote:As you remember, I am still in voc rehab, going on my third year with my ninth counselor(I think, I lost count).
This morning she called, wanted an update on job history. She already has it for the past 20 years, this time she needed it from 1971(when I graduated from high school) until 1990. Who can remember all?

We actually had a conference call with lawyer's assistance and she strongly protested, why they need this going back to such a long time? Counselor said, new regulations.

Anyone had this experience? Am I the only one who is going through this madness?

Kat

Hi, I know what you are talking about with voc rehab. I am in florida and the counslor wanted every job I have every held and my attoreny explained is why , They want to see if they can match you with a job that has anything to do with what you have done in the past that way they dont have to send you for retraining and get out of not paying you. That is what my lawyer told me. He said just tell them and if you forgot a job just be honest and tell them you cant remeber every job. I dont know if this is what is going on for you but just a thought. I really hope things work out for ya. good luck

Bad Boy,

My lawyer says, the two year limit applies to re-training or on the job training only, nothing else. I am still in the "assesment progress" ever since 2006 since no formal re-training or on the job training approved or planned out.

Lilly, it's like a chess game...wait until other party moves than we move.
Now as I had my three IME's last week(one ortho, one neuro, one psych), they supposed respond to voc counselors JA's and probably they will approve all four.
After that my own doctor suppose to respond and we take it from there according to lawyer.
I will keep you posted what happens.

Thanks again for caring.

RE: Vocational Rehab
Hi,
Apparently, you don't have results/reports of the IMEs yet...it will be interesting to see what they say.
Keep us updated, ok?
