Question In IA 2 back surgerys, confussed!!
Hi I got ruptured disc in dec. 07 had surg in jan. 08 went back to work light duty and then in aug. pain started getting severe again , had mri same disc ruptured again putting major pressure on nerve once again had to have surgery fusion this time , went back to work dec. 27 light duty, in jan. work comp. insurance guy sent me a check and started paying me for 10%ppd telling me that it was ato 10% just for surgery , Well in feb went back to surgeon and they said i am not fusing so they want to do another surgery, I refused because the other 2 scared me to bad , so they set up FCE and i had that , I just got letter from Dr. showing fce was 23%, my job is trying to find work to accomidate me , but my ? is will the 10% be added to the 23% to be 33%, And also will i be covered if say a year from now i have the 3rd surgery? Should I get a lawyer? I'm kind of worried they are doing me wrong. Would love input from anyone!!

I Agree that You should at the Very Least Speak with an Attorney that deals in w/c to Make Sure that You are being Treated Fairly. I am a Disabled with a Work Related Lower Back Injury, and I could have Never gotten as Far as I Have without an Attorney. They have Attorney's on Their Side, and in My Opinion so should You, to be Sure that You get the Monetary and Medical Care You Need! A Spinal Injury is Very Serious, and a Life Long Medical Situation that will Change in Time, and You will need the Medical Coverage should they not be able to Get Your Spine Stable, which is My Problem. I am in Pain Management because Nothing Else can be Done with Me, Hopefully they can get Your Condition Corrected, and You can Live a Somewhat Normal Life! Welcome to the Forum, there are Great Folks Here with a Lot of Knowledge, and I'm Sure Someone from Your State will be on Soon to Give You Some Assistance!!Wink

Failed Back Surgery, Chronic Pain, Totally Disabled.

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!

if they are different ratings for the same impairment then the final rating is likely to be somewhere in between.

Is the doctor rating the FCE at what you were able to perform, such as you performed 23% of the FCE? For an FCE is not rated, the injured body part, or the body as a whole is rated.

Call a lawyer....back surgery & problems are high dollar, and known to cause life long problems as one gets older. You want to be assured you are getting a fair shake...and they WILL try to slight you if given the chance. Remember, WC/IC has a team of attorney's working full time to snow you over....you need one too, to be on even battling ground!

What is sounds like to me, is that the IC started paying you 10% PPD while they awaited a Dr rated PPD percentage. Your Dr. says 23% so if the IC doesn't disagree and appeal, your PPD should go up to that amount per your state quidelines, and the IC will have to back pay you 13% PPD for the time that they have just paid the 10%.
