Multiple Employers
My spouse was killed in an accident at work. He was employed at several locations around the city. We live in the state of Alabama. Will my children and I be paid workman's comp for just the employer that is responsible for his death, or should we receive compensation for ALL the wages that were taken from us? Any help or where to turn would be greatly appreciated.

I have contacted an attorney, but he is just going by the average weekly rate the company is providing. But that is not NEAR what he made total. I have researched online but can only find that the company would have to pay 66 2/3 of the average weekly rate, but no mention of how that is affected by multiple employers. Any idea where else to look?

I don't know the laws in your state, but I had two employers and was not able to return to either job. My benefits are based on income from both jobs as it is all lost wages. Sorry to hear of your loss. I once worked for a company where a co-worker had died and the company themselves went above and far beyond to make sure his familly was taken care of.I hope that your husbands employers will do the same for you.

if the death benefit is at the statutory maximum rate additional earnings will not affect the payout.

vsablya, so sorry to hear about your loss. When I talked to my lawyer my wife would have recieved a benifit of 200,000. Not sure on the exact amount but every state is different. also you might be able to recieve benifits for each of your children. I would seriously talk to a lawyer or your ombudsman in your state...................Bronco
