My husband (34yrs old) was injured over a year ago after about 3 months of the insurance companies doctor telling him he just had a pulled muscle in his back he hired an attorney, his attorney sent him to one of their doctors a spinal injury doc we found out that he had 2 bulging discs and 1 that pretty much was no longer there, in the mean time because he could not stand up straight his spine had shifted he walks like he is 80, he loses feeling in both of his legs. Pain meds don't seem to work anymore. Since this all began they have reduced his work restrictions to can't lift over 10lbs to 5lbs, no prolong standing, can't walk more than 100ft, etc, etc, etc,job he was injured at wouldn't comply with the original work restrictions went to another job needless to say he was let go from this employer due to the restrictions changing. Went to another job no problems with work restrictions intill they got slow and needed to move him from his hired position to another that required lifting had to let him go. Had a discogram wc doctor says he needs surgery, sent him to 2nd wc doctor of theirs that one says surgery too, mean while can't work won't give him wc benefits, now they want to send him back to the 2nd doc to get more MRI's, etc. etc., their attorney keeps canceling court dates, mean while on 1 income with 4 kids, all the Kansas WC laws say he is intitled to benefits but not getting them!

get your lawyer to grow some teeth.....
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

I keep telling my husband that I don't think his attorney is doing his job, but he makes a good point, if we changed wouldn't this process start all over again, now we've found out they want more MRI's with the 2nd wc doctor which means they will prob cancel the court date this month on the 24th so they can wait on new information which means it will delay benefits even longer, my husband is about to just give up, I told him thats what they want! |

If you don't think your attorney is doing his job sit down and talk with him. You have to make sure you are on the same page with him. Nothing happens very fast on WC, sounds like he is getting hearing set up but canceling them could be the right thing to do depending on whats going on. You need to talk with him and make sure. My work cut my pay in April 2007 and then stopped WC payment in July 07. Took until Nov 2008 to get a hearing, was awarded back payments from this in Jan but because work has filed a review it could be another year before I see any money. It's hard to deal with and can take lots of time but that is why you need to believe in you lawyer. This board is a great place for answers and support so hang in there, as you said work just wants him to give up so they don't have to pay. But his health is something you have to take care of. Not just so he can return to work and make money but so he can try to have a life without pain. We will pray for him.
