BACK INJURY/wc benefits
I recently got approved for my WC benefits; as soon i got approved I RETAINED A LAWYER; my question is this, my lawyer sent me to a new doctor; my old doctor keeps calling me for missed appointments etc. etc,can they terminate my benefits because I NOW HAVE A LAWYER?iam in california; would appreciate any suggestions or comments ....iam facing a 5 disk surgery;;;

No. retaining a legal representative is not grounds for denying benefits under California work comp laws.

They are not required to pay disability benefits without approval from your authorized treating physcian. If you want to change then the new doctor has to be within their medical provider network and you need to notify them of the change.

missed appts are a big NO NO are you missing them or your old Doctor.....Missing Doctor appts are reason enough for them to get you for non compliance
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

If you cannot make it to your doctor appointments you need to cancel them to let them know or they can still charge you for the missed appointments. I have always been good about contacting my doctors if I cannot make it. They can stop your claim if you do not show up or at least call to let them know you are not coming in that day etc. I would just call and tell them you have another doctor and to cancel the appointments they had set for you.

If you were given a doctor to see by your employer or WC you should let that doctor know that you have another doctor. ALSO, you need to make sure that the doctor you are seeing has been approved by WC. I wanted to change care, but had to let WC know first and then they paid my claims. My attorney always tells me to follow the rules, get permission and when WC is out of line, let them do the work. I have had no problems with WC because I always let them know who, what, where, when and how. My attorney only gets involved if I am denied treatment that has been suggested for me. I will go as long as I can and when there is nothing left for me to do to get better, my attorney will take over. Stay on tip of things, keep track of your mileage to the doctors and receipts for parking, etc.. Keep a log of everything you do regarding your care, because when the time comes for you to remember something, you need to know what happened. Trust me, they will know what they need to know when they (WC) decides to question your care or deny your benefits. Do not give them any reason NOT to take care of you.
Working in a hospital gives me great insight on what is expected from the patient. Trust me, they are keeping records on you, so you keep records on you and them! |
