Do i have to provide medical records for the past 5 years, even if they have nothing to do with my injury? example: sickness, mental information, hair loss, weight gain, weight loss, knee problems, etc.

RE: medical records requested.
nope.....when they sent my forms to me for medical release I stipulated for it to only cover the injured body part......now mine was my back and neck so they could go back as far as they could checking for any back or neck injuries as is their right.....but how long I was in labor or the stitches was none of their business...only what related to the comp claim
;)Workmans comp is not a road you want to travel alone. You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life, you have come out ahead of the game.....

RE: medical records requested.
if they want to press the issue they can take you to court and ask the judge to order full disclosure during discovery-especially if the doctors require them.

RE: medical records requested.
it's not unusual for issues of establishing causal relationship and makes no difference what you may or may not stipulate although as stated, it may require some extra work on their part. What they do with your protected medical information is another matter.

RE: medical records requested.
Sorry to say, when You Enter the Wonderful World of w/c, Your Life becomes an Open Book! You can Fight them as Jayne Said, but in the End they will get the Info. they Need. So I guess it's a Matter of whether You want to Start this w/c Process Easily, or if You want to Start the Battling Right Off the Bat. I Personally Signed for All of My Records Up Front, as I had no Major Back Issues before My Injury. Best of Luck, I Hope All Goes Well!
Failed Back Surgery, Chronic Pain, Totally Disabled. Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!! |
