no w/c for injured in n.c.
I work for a trucking co. and I hurt my back in Dec. 2008. I did exactly as my employer told me to i.e. go to hospital,ect.... When the claims were filed I was denied payment for my injuries as well as medical payment, and loss of wages... I was told by the insurance company that they did not have coverage for anyone who lived in or got hurt in the state of north carolina. The company I work for is located in Georgia. I am at my wits end. I do not know what to do about this and cant' seem to find anyone who does. I contacted a lawyer and now he says I should contact another lawyer in Georgia!! Please help if you know anything that can help me.

North Carolina has a fund to pay for claims of uninsured employers. For information on how to apply contact one of the specialists:

My opinion;

Sounds like employer wasn't properly Insured as per their Employment duties per the work being performed....

I really don't know. All I know is what the insurer told me. They said that my employer did not have W/C for anyone hired out of or that resides in North Carolina. They are out of Cairo Georgia. I am an over the road truck driver that works for this company not an owner opperator. I thought it was a law that you had to cover your employees during working hours regardless of where they live. I'm still confused as to what to do. I hope the post above will help me to find out what my rights are.

I just spoke with the specialists about my case. They have told me that it is unlawful for them not to have insurance coverage for me or others in N.C. I have requested a hearing in this case on their recomodation in this case. They have also told me that I need to have a lawyer for this case. If you have any suggestions about this please let me know I would appreciate it.
Unfortunatly for me I have had to move from my residence since I have no income at this time. I am staying with family for now. To find a lawyer it would have to be someone who would represent me until this is over. I'm not sure how this works since I have never had to retain a lawyer in the past...any suggestions would be appreciated.

most WC lawyers get paid a % of what they get you......but if they have no WC insurance can you file a cival suit agaist them? Timothy Belt is a lawyer on here out of PA. he might no of one near you
